Business insurance in Hamilton County
The County says most of Hamilton County's businesses are tourism-related, in Speculator, Indian Lake, Long Lake, Lake Pleasant and the county's other towns. Here's what a business in the county usually needs, and the county permits and filings that touch insurance.
A Hamilton County small business needs workers' compensation from the first employee, part-time and seasonal staff included, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. The County says most of its businesses are in tourism, so lodging, restaurants and visitor businesses carry guest liability, and bars add liquor liability. Work in a county road needs a County Highway Department work permit, which makes you responsible for injury and damage and asks you to certify workers' compensation for everyone on the job. My office is in Clifton Park, and I work with Hamilton County businesses by phone, email and video.
What's different about insuring a business in Hamilton County
- A tourism economy. The County's economic development office says the majority of the county's businesses are in tourism-related enterprises. Lodging, shops and restaurants usually fit a business owners policy with business income; see restaurant and bar insurance, retail shops and liquor liability.
- Staff for part of the year. New York's workers' compensation applies from the first employee, part-time and seasonal staff included, and DBL and Paid Family Leave once someone has worked 30 days in a calendar year. Payroll that swings with the season is settled at the audit, so keep the records.
- Contractors and caretakers. Building, plowing and looking after visitor properties needs general liability, commercial auto for trucks and plows, and inland marine for tools. See contractor insurance and handyman insurance; the Scaffold Law applies on every roof.
- County highway permits. Work in a county road, from a new driveway to buried cable, needs a County Highway Department work permit that makes you responsible for injury and damage, indemnifies the County and certifies workers' comp for everyone on the job.
- IDA loans and incentives. The County IDA runs a small business loan fund secured by property, equipment or vehicles, and offers tax incentives for new or expanding businesses. Collateral usually has to be insured; I check the policies against the loan papers.
- Business names. A sole proprietor or partnership trading under an assumed name files a business certificate with the County Clerk in Lake Pleasant. New LLC? See business insurance for a new LLC.
What Hamilton County businesses carry
Required by New York
Workers' compensation from the first employee and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Business vehicles need commercial auto.
Required by your landlord, clients, lender and the County
General liability naming them as additional insured, with the wording their leases, contracts or permits ask for, or a business owners policy for a lodge, shop or small restaurant.
Worth adding
Flood insurance, since commercial property excludes flood wherever you are; check your address on FEMA's map. Also employment practices liability once you have staff, and a commercial umbrella above general liability and auto.

Common questions
Short answers to what people ask before they call.
Still have a question? Call (518) 902-8822 or book a call.
I'm a sole proprietor using a business name. Where do I file it in Hamilton County?
With the Hamilton County Clerk, who files business certificates, at 102 County View Drive in Lake Pleasant. Under General Business Law §130, a person or partnership doing business under an assumed name files a certificate with the clerk of each county where the business is conducted, so a business working in Hamilton County and a neighboring county files in both. Call the Clerk's office for the form. Put the same name on your policies, so certificates and claims match.
I'm a contractor working in a county road. What does the County want?
The County Highway Department's work permit, under Section 136 of the Highway Law, covers sewer and water mains, driveways, new poles, buried cable and other work in a county road. It makes you responsible for bodily injury and property damage from the work, has you indemnify and hold the County harmless, and has you certify that everyone working under the permit is covered by workers' compensation. For a new driveway, the County inspects the site and specifies the culvert. Once your policies are in force, I get you the certificates; the contractor page covers the rest, including the Scaffold Law for work at height.
I run a lodge, restaurant or shop for visitors. What do I need?
General liability for guests on your premises, usually inside a business owners policy with business income, so a fire or frozen pipe doesn't also take the income. Serving alcohol adds liquor liability under the Dram Shop Act. Equipment you rent out, from boats to bikes, needs inland marine cover and a rental agreement the carrier accepts. Staff you hire for part of the year need workers' comp from the first day, and DBL and Paid Family Leave once they've worked 30 days in a calendar year.
I'm borrowing from the County IDA's loan fund. What insurance will I need?
The IDA's small business loans ask you to list the assets that could secure the loan, such as property, equipment or vehicles. Lenders usually want collateral insured for its value and may ask to be named on the policy, so check the loan papers when they arrive and send them to me. I'll make sure the property, equipment and auto policies match what the lender asks for.
