Business insurance in Montgomery County
Montgomery County sits along the Mohawk: distribution centers and food makers in the business parks, farms across about half the county's land, and villages from Fort Johnson to St. Johnsville along the river. Here's what a business in the county usually needs, the county permits and filings that touch insurance, and the town page with the local detail.
A Montgomery County small business needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. Contractors working on or across a county road need a permit from the Department of Public Works, and the permit asks for a protective liability policy and a certificate naming the County as additional insured. The County's hazard plan lists flooding along the Mohawk and its creeks, including ice jams, and commercial property policies exclude flood. My office is in Clifton Park, and I work with Montgomery County businesses by phone, email and video.
What's different about insuring a business in Montgomery County
- Distribution, logistics and food. The County's 2025 hazard plan lists three business parks, Florida Business, Florida Business Extension and Glen Canal View, home to distribution centers and food and farm businesses, and the Business Development Center targets logistics, advanced manufacturing and food manufacturing. Truckers and contractors serving them need trucking or commercial auto cover and certificates for every customer.
- County road permits. Work on or across a county road needs a Department of Public Works permit. The miscellaneous structure permit asks for a protective policy for the County and a general liability certificate naming it as additional insured, with workers' comp and disability coverage, sole proprietors included. See contractor insurance; the Scaffold Law applies on every roof and facade.
- Farms. The same plan puts about half the county's land in agriculture. Selling to the public or making a product adds product liability, and farm vehicles on the road need the right auto cover.
- The Mohawk, its creeks and ice jams. The plan lists locally identified flooding in river and creek communities from St. Johnsville to Fort Johnson and judges flooding and ice jams highly likely in future. Commercial property excludes flood; flood insurance is a separate policy, and sewer backup a separate endorsement.
- Main streets. Most working residents are in healthcare, manufacturing, retail, warehousing and food service. Shops, offices and restaurants usually fit a business owners policy; bars and restaurants add liquor liability under the Dram Shop Act.
- Business names. A sole proprietor or partnership trading under an assumed name files a Business Certificate with the County Clerk in Fonda. New LLC? See business insurance for a new LLC.

Common questions
Short answers to what people ask before they call.
Still have a question? Call (518) 902-8822 or book a call.
I'm a sole proprietor using a business name. Where do I file it in Montgomery County?
Under General Business Law §130, an individual or partnership doing business under an assumed name files a certificate with the county clerk in each county where the business is conducted. The Montgomery County Clerk in Fonda takes the Business Certificate for a sole proprietorship or partnership; search the Clerk's records first, because the form has you certify that no business there has the same name, and it is signed before a notary. File an amendment if partners, the name or the address change, and a discontinuance if the business closes. Some banks want a certified copy with the raised seal. Put the same name on your policies, so certificates and claims match.
I'm a contractor working on or across a county road. What insurance does the County want?
The Department of Public Works permit for miscellaneous structures asks, unless the Commissioner waives it, for an owners and contractors protective policy covering the People of the County of Montgomery and the Commissioner, and a certificate of general liability naming the County as additional insured, with a waiver of subrogation, on a primary and non-contributory basis, with XCU, per-project aggregate and contractual liability, at the limits printed on the form. It also wants proof of workers' compensation and disability coverage, sole proprietors included. Send me the form and I'll check your policy against every line.
My business is near the Mohawk or one of its creeks. Am I covered if it floods?
Not by a standard commercial property policy; flood is excluded. The County's 2025 hazard mitigation plan lists locally identified flooding along the Mohawk and creeks in St. Johnsville, Minden, Fort Plain, Canajoharie, Fonda, Fultonville, Fort Johnson, Ames, Nelliston, Burtonsville and the Town of Amsterdam, and judges both flooding and ice jams highly likely in future. Flood is a separate policy, through the National Flood Insurance Program or a private carrier. Send me the address and I'll look it up on FEMA's map.
I'm a trucker or warehouse contractor working for the distribution centers. What do they ask for?
Usually general liability, auto or trucking liability and workers' comp, each with the customer named on certificates, and often an umbrella above them. Contracts vary, so send me the insurance section of yours and I'll show you where your current policies fall short before you sign.
