A Herkimer County small business needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. What's different about insuring a business in Herkimer County
- Mohawk Valley manufacturing. The County's 2024 hazard plan says metal fabrication has long been a large share of the county's manufacturing jobs, and that its spot on I-90 makes it a candidate for smaller warehouses, pointing to a distribution facility in Frankfort. Plants need commercial property with business income, and truckers and contractors serving them need trucking or commercial auto cover and certificates for each customer.
- Adirondack visitors. The plan puts the northern part of the county in Adirondack Park and describes a tourism economy built on its forests, parks and waterbodies. Inns, shops and restaurants usually fit a business owners policy; bars add liquor liability under the Dram Shop Act, and equipment you rent out needs inland marine cover.
- Main streets and farms. Retail employs more people than any other sector in the plan's figures, and the plan says the southern valleys have long sustained industry and dairying. Shops see retail insurance; farms selling to the public add product liability and need the right auto cover for farm vehicles on the road.
- County highway permits. Utility and road work needs a County Highway Department permit with an indemnity for the County and proof of insurance, and overweight loads need a load permit that holds the County harmless. See contractor insurance; the Scaffold Law applies on every roof and facade.
- The Mohawk, its creeks and ice jams. The plan rates flooding as frequent, lists ice jam flooding on the Mohawk and six creeks and brooks, and says most people live along the river and its tributaries. I'm a sole proprietor using a business name. Where do I file it in Herkimer County?
With the Herkimer County Clerk, at 109 Mary Street in Herkimer. Under General Business Law §130, a person or partnership doing business under an assumed name files a certificate with the clerk of each county where the business is conducted. The Clerk has separate forms for an individual and a partnership, each signed before a notary, plus an amended certificate for a new name or address and a certificate of discontinuance if the business closes. The form says a certified copy is to be displayed at each place the business is conducted. Put the same name on your policies, so certificates and claims match.
I'm a contractor or utility working in a county road. What does the County want?
The County Highway Department's utility work permit, under Section 136 of the Highway Law, asks you, your employees and contractors to indemnify, defend and hold Herkimer County harmless for claims arising from the work. It says you must carry adequate insurance for your operations, equipment and personnel and submit proof of insurance with the application, and the Superintendent may ask for a deposit or performance bond. I haul logs, aggregate or machinery. Do county roads need a permit?
Loads over New York's weight or size limits need a County Highway Department permit to move over county highways, divisible or non-divisible, and posted roads have seasonal load limits. My business is near the Mohawk or one of its creeks. Am I covered if it floods?
Not by a standard commercial property policy; flood is excluded. The County's hazard mitigation plan rates flooding as frequent and says the county could see at least one flood event each year. It records ice jam flooding on the Mohawk, West Canada, East Canada, Fulmer, Moyer and Steele Creeks and Bellinger Brook, and finds the Village of Ilion has the highest share of residents in the 1-percent annual chance flood area.
