Business insurance in Little Falls

Little Falls is a small city on the Mohawk River and the Erie Canal: a Main Street being rebuilt with State downtown money, Canal Place and the City harbor along the canal, and old mills and an industrial parkway by the river. Here's what a business here needs, and the City rules that change it.

In short

A Little Falls small business needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. Owners using the City's Downtown Improvement Grant Fund must carry paid hazard insurance that covers their mortgages and the grant. The City makes owners and occupants keep sidewalks clear of snow and ice, asks contractors cutting a street for certificates naming the City, and wants an insurance rider with every large event application. My office is in Clifton Park, and I work with Little Falls businesses by phone, email and video.

What's different about insuring a business in Little Falls

  • Main Street and the DRI. The State's Downtown Revitalization Initiative projects for Little Falls include a redesigned Main Street canopy, a new streetscape with a separated bike lane from Albany Street to Ann Street, senior housing with commercial space in the M&T Building, and the vacant former hydroelectric facility on the waterfront turned into offices and a film production hub. Shops and offices fit a business owners policy; see retail and restaurant insurance.
  • Downtown Improvement Grants. The City's grant fund pays toward facade, fit-up, HVAC, electrical, plumbing, equipment and upper-floor apartment work on commercial and mixed-use buildings, with priority on East and West Main Streets, and tenants can apply for equipment. The property has to carry paid hazard insurance covering its mortgages and the grant, under a five-year commitment secured by a lien. See commercial property and apartments above shops.
  • Sidewalks. City Code Chapter 94 puts the duty to keep sidewalks clear of snow and ice on the owner and the occupant, and lets the City clear and bill after six hours. It also bars merchandise that blocks the sidewalk and controls steps, cellarways and cellar trapdoors. Falls on the frontage land on general liability.
  • Vendors, food trucks and events. The City Clerk issues vendor and solicitor permits and wants Health Department, State and liquor permits disclosed; food trucks show fire extinguisher, hood suppression and propane paperwork; a large event permit needs an insurance rider attached when you apply. See food truck insurance and liquor liability under the Dram Shop Act.
  • Road cuts. Excavation in a City street, sidewalk or curb needs a Board of Public Works permit with certificates naming the City as additional insured and proof of workers' comp, and the contractor stays liable until the final repair. See contractor insurance; the Scaffold Law applies on every roof and facade.
  • Mills, the parkway and the canal. The City's investment page points to shuttered mills and vacant commercial buildings near the waterfront for reuse and to Riverside Industrial Parkway for manufacturing or warehousing, and the City harbor opens while the Canal is open. A building left empty can lose property cover under a vacancy clause, and plants and warehouses need business income with their property cover. The County's hazard plan puts only a small share of city residents in FEMA's 1-percent flood area, so check your own address on the map; flood insurance is a separate policy.

What Little Falls businesses carry

Required by New York

Workers' compensation from the first employee, part-time and seasonal staff included, and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Business vehicles need commercial auto.

Required by your landlord, your clients and the City

General liability naming them as additional insured, including the City of Little Falls on a road cut permit, with the wording their lease, contract, permit or grant asks for, or a business owners policy that packages liability with property and lost income for a shop, office or small restaurant.

Worth adding

Cyber for card payments and online sales, employment practices liability once you have staff, inland marine for tools and equipment on the move, a commercial umbrella above general liability and auto, and flood insurance if FEMA's map puts your address in a flood zone.

Questions

Common questions

Short answers to what people ask before they call.

Still have a question? Call (518) 902-8822 or book a call.

I'm applying for a Downtown Improvement Grant. What insurance does the City want?

The City's program summary says the property, which has to be commercial or mixed-use and inside the DRI target area, must carry sufficient paid hazard insurance to cover any outstanding mortgages plus the grant the City provides. You commit to own and maintain the property for five years, secured by a recorded lien, and the grant reimburses the work after it's paid for. So the policy has to be in force before you apply and stay in force through the work and the five years: insure the building at what it would cost to rebuild, tell the carrier before renovation starts, and expect the City to want proof. Send me the grant paperwork and I'll check your policy against it.

Who is responsible for the sidewalk in front of my shop in winter?

Under Chapter 94 of the City Code, the owner and the occupant of every lot have to keep the sidewalk clean and free from snow and ice. If snow or ice stays on it for more than six hours, not counting 9 p.m. to 7 a.m., the City can clear it and bill the owner. The same chapter bars goods or merchandise that block the sidewalk, needs the City Engineer's written permission for steps or cellarways from the sidewalk, and says a cellar trapdoor stays closed except while goods are being delivered. A fall on an icy or blocked sidewalk lands on your general liability, so your lease should say who clears it, and both the landlord's and the tenant's policies should cover the frontage.

I want to sell from a food truck or a stand, or run an event in Little Falls. What does the City ask for?

A vendor or solicitor permit from the City Clerk, for a single event, door-to-door sales or an annual single location. It asks whether you hold Health Department, other State and liquor permits, and wants copies of the driver's license and vehicle registration for everyone selling. Food trucks also show a Health Department permit, current fire extinguisher tags, a hood suppression tag where needed and propane documentation. A large event permit needs an insurance policy rider attached when you apply, by January 1 for yearly events and at least 60 days ahead for others. See food truck and liquor liability insurance; once your policies are in force, I get you the certificates.

I'm a contractor cutting into a City street or sidewalk. What does the City want?

A road cut permit from the Board of Public Works for any excavation in a street, sidewalk, curb or grass in the right of way. You submit insurance certificates listing the City of Little Falls as additional insured on your general liability, with proof of workers' compensation, at the minimums printed on the form, plus a traffic control plan and two sets of plans. You stay solely responsible for the work and liable until the final repair is done, and you call Dig Safely New York first. The contractor page covers the rest, including the Scaffold Law.
