Business insurance in Fulton County

Fulton County is where the southern Adirondacks meet the Mohawk Valley: Gloversville and Johnstown, the Great Sacandaga Lake and dozens of smaller lakes, and visitors in every season, from fishing tournaments to snowmobile trails. Here's what a business in the county usually needs, the county filings and permits that touch insurance, and the town page with the local detail.

In short

A Fulton County small business needs workers' compensation from the first employee, seasonal staff included, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. Around the Great Sacandaga Lake and the county's other lakes, businesses built on visitors add boats, docks and a closed or quiet season that the policy has to know about. Work in a county road's right-of-way needs a permit from the Highways and Facilities Department. My office is in Clifton Park, and I work with Fulton County businesses by phone, email and video.

What's different about insuring a business in Fulton County

  • The Great Sacandaga and the lakes. The County counts 44 lakes, the Great Sacandaga the largest. Boat and kayak rentals, docks and swimming areas are exposures general liability excludes or limits, so they have to be written in. Lakeside restaurants and bars add liquor liability under the Dram Shop Act; see restaurant and bar insurance.
  • Four seasons of visitors. The County markets itself as a four-season destination, with fishing tournaments in every season and snowmobilers on groomed trails and frozen lakes. Seasonal staff are covered by workers' comp from the first day, and a quiet season belongs on the application, because property policies limit cover for buildings left vacant.
  • New development. The County's development strategy names Primary Development Areas at Hales Mills, Tryon and Vail Mills, with housing, retail, commercial space and lodging planned. New buildings need builder's risk before construction and commercial property at replacement cost after.
  • County road work. Work in a county highway right-of-way needs a permit from the Highways and Facilities Department, with plans and a site review, under OSHA and New York's Industrial Code. See contractor insurance; the Scaffold Law applies on every roof and facade.
  • Farms and makers. The County describes a history of making and growing things, with local farms and agri-businesses. Selling to the public or making a product adds product liability, and farm and work vehicles need the right auto cover.
  • Business names. A sole proprietor or partnership trading under an assumed name files a business certificate with the County Clerk in Johnstown. New LLC? See business insurance for a new LLC.

Questions

Common questions

Short answers to what people ask before they call.

Still have a question? Call (518) 902-8822 or book a call.

I'm a sole proprietor using a business name. Where do I file it in Fulton County?

Under General Business Law §130, an individual or partnership doing business under an assumed name files a certificate with the county clerk in each county where the business is conducted. The Fulton County Clerk, in the County Office Building at 223 W. Main Street in Johnstown, handles business certificates, DBA applications and partnership agreements, and posts business certificate forms for individuals and partners. Put the name exactly as you trade under it on your policies, so certificates and claims match. If you formed an LLC instead, my LLC guide covers what changes.

My business is by the Great Sacandaga Lake. What should the policy cover?

Tell the carrier everything that happens on the water and the shore: docks, a swimming area, and any boats, kayaks or snowmobiles you rent or lend, because general liability excludes watercraft you own or rent to others and those need their own cover. If you close or slow down for part of the year, say so, since commercial property policies limit cover for buildings left vacant beyond a set period. Workers' comp is priced on payroll and audited afterward, so give the real seasonal payroll up front.

I'm doing work in a county road's right-of-way. What does the County need?

A Highway Right of Way Work Permit from the Fulton County Highways and Facilities Department, at 2712 State Highway 29 in Johnstown. You send the application with engineering plans, the department does a site review, and the work has to follow OSHA and New York's Industrial Code Rules 23 and 53. The form I read doesn't set insurance terms, so ask the department whether it wants a certificate; the owner or utility hiring you usually does, and I get you those certificates once your policies are in force.

I'm opening in one of the county's new development areas. What do I settle first?

Fulton County's development strategy names three Primary Development Areas: Hales Mills in the Town of Johnstown, Tryon in the Town of Perth, and Vail Mills in the Town of Mayfield, planned for housing, retail, commercial space and, at Vail Mills, lodging near the gateway to the Great Sacandaga. Before construction, settle builder's risk or property cover and ask every contractor for certificates; before you open, the lease or lender will set your liability limits and additional insureds.
