Business insurance in Otsego County

Otsego County's businesses are the museums, inns, restaurants and shops that serve Cooperstown's visitors, the stores, offices and hospitals of Oneonta, manufacturers, and dairy and other farms. Here's what a business in the county usually needs, and the county permits and filings that touch insurance.

In short

An Otsego County small business needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. Tourism is one of the county's largest industries, so inns, restaurants, shops and drink makers in and around Cooperstown add liquor and product liability. Work in a county road needs a County highway work permit, which asks for protective liability and workers' compensation insurance. The County's hazard plan says towns along the Susquehanna take heavy damage in floods, and commercial property policies exclude flood. My office is in Clifton Park, and I work with Otsego County businesses by phone, email and video.

What's different about insuring a business in Otsego County

  • Visitors. The County's 2021 hazard plan calls tourism one of the county's largest industries, naming the Baseball Hall of Fame, the Fenimore Art Museum and the Farmers' Museum in Cooperstown, the Cooperstown Beverage Trail and Oneonta's theatres. Inns, shops and restaurants usually fit a business owners policy; see restaurant and bar insurance, retail shops and liquor liability for tasting rooms and bars.
  • Oneonta and the service economy. The same plan counts retail, accommodation and food service, and health care as the county's most common businesses, with hospitals in Cooperstown and Oneonta and two colleges, SUNY Oneonta and Hartwick College. Offices and clinics see medical and dental office insurance and professional liability.
  • Manufacturers and farms. The plan lists products from communications equipment to food and beverage, and dairy, cattle and crop farms across the county. Plants need commercial property with business income, selling what you make adds product liability, and farm and delivery vehicles need the right auto cover.
  • County highway permits. Any work in the county right of way needs a highway work permit from the County Highway Department in Cooperstown, with protective liability insurance, workers' comp for the whole permit period and an indemnity for the County. See contractor insurance; the Scaffold Law applies on every roof and facade.
  • The Susquehanna and its creeks. The plan says towns along the river sustain extensive damage in floods, describes flooding in low-lying Oneonta and ice jams on the Susquehanna, Unadilla and Otego Creek, and says no community is exempt. Commercial property excludes flood; flood insurance is a separate policy, and sewer backup a separate endorsement.
  • Business names. A sole proprietor or partnership trading under an assumed name files with the County Clerk in Cooperstown. New LLC? See business insurance for a new LLC.

Questions

Common questions

Short answers to what people ask before they call.

Still have a question? Call (518) 902-8822 or book a call.

I'm a sole proprietor using a business name. Where do I file it in Otsego County?

With the Otsego County Clerk, at 197 Main Street in Cooperstown. Under General Business Law §130, a person or partnership doing business under an assumed name files a certificate with the clerk of each county where the business is conducted. The Clerk checks that the name isn't already in use, and the form is signed in front of a notary, so don't sign a downloaded copy beforehand. If you open a bank account in the business name, the bank will want the filing and a certified copy. File an amendment if the address or other details change. An LLC or corporation using another name files with the Department of State instead. Put the same name on your policies, so certificates and claims match.

I'm a contractor working in a county road. What insurance does the County want?

The County's highway work permit, under Section 136 of the Highway Law, covers any work in the county right of way, from driveways and curbs to water, sewer and electrical lines. It asks for protective liability insurance to the Highway Department's requirements and workers' compensation for the entire period of the permit, or the permit becomes invalid. You are responsible for injury and property damage from the work and agree to indemnify and hold the County harmless, and a bond or certified check may be required to secure restoration. Send me the application and I'll check your policies against it.

My business is in Oneonta or along the Susquehanna. Am I covered if it floods?

Not by a standard commercial property policy; flood is excluded. The County's 2021 hazard mitigation plan calls the Susquehanna the largest river in the county and says towns along it sustain extensive damage in floods. It describes backwater from the river flooding low-lying parts of Oneonta, especially the 6th Ward, overflow along Oneonta, Silver and Glenwood Creeks, and ice jams on Otego Creek and the Susquehanna and Unadilla rivers. Flood is a separate policy, through the National Flood Insurance Program or a private carrier. Send me the address and I'll look it up on FEMA's map.

I run an inn, restaurant or tasting room near Cooperstown. What changes?

Guests on your premises need general liability, usually inside a business owners policy with business income, so a fire or burst pipe doesn't also take the income. Serving alcohol adds liquor liability under the Dram Shop Act, and selling beer, wine, spirits or food you make adds product liability. Events and markets usually ask for a certificate naming them. Tell me everything you do when you ask for a quote, so nothing is left out.
