Business insurance in Middleburgh
Middleburgh's businesses are on a historic Main Street in the Schoharie Valley, in short-term rentals the Village regulates, and on the farms around the village. Here's what a business here needs, and the Village rules and local risks that change it.
A Middleburgh small business needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, and the general liability its landlord and clients ask for. Main Street is a historic facade district, so property there needs terms that will rebuild an older building to the Village's standards. Short-term rentals need a Village permit with proof of hazard and liability insurance. The county's hazard plan says the village grew up mainly in the Schoharie Creek floodplain, and commercial property policies exclude flood. My office is in Clifton Park, and I quote Middleburgh businesses across the carriers I represent.
What's different about insuring a business in Middleburgh
- Main Street. Main Street was the center of the village's business district, its look shaped in the Victorian period, and the county's economic development strategy names Middleburgh among its villages with walkable, mixed-use centers and a role as a retail center. Shops and offices fit a business owners policy; restaurants and bars add liquor liability under the Dram Shop Act. See retail shops and restaurant and bar insurance.
- The facade district. The Village's facade law covers both sides of Main Street from River Street to Route 145 and asks that historic facades be kept or restored, with changes reviewed by the Joint Planning Board and the Code Enforcement Officer. Commercial property should be written at replacement cost with ordinance-or-law coverage for what those standards add to a rebuild.
- Schoharie Creek. The county's hazard plan says the village developed mainly in the Schoharie Creek floodplain, was among the hardest hit in 2011, and was under a state of emergency after flash flooding in June 2013. Commercial property policies exclude flood; flood insurance is a separate policy, and sewer backup a separate endorsement.
- Short-term rentals. The Village's Local Law 1 of 2024 cites growing tourism and limits short-term rentals to the Commercial and Historic districts, with a yearly permit, an annual fire and safety inspection, and proof of hazard and liability insurance. The rental has to be named on the policy; see landlord insurance.
- Village pavilions, events and food trucks. Using the Baker Avenue or Timothy Murphy Park pavilion means signing an indemnity for the Village, with no alcohol on Village property and insurance in place first where the Village requires it. Food trucks file a Village mobile food vehicle application; see food truck and vendor insurance.
- Farms around the village. The county's hazard plan describes much of the Town of Middleburgh as agricultural and in a state agricultural district. Selling to the public adds product liability, and farm vehicles on the road need the right auto cover.
What Middleburgh businesses carry
Required by New York
Workers' compensation from the first employee, part-time and seasonal staff included, and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Business vehicles need commercial auto.
Required by your landlord, clients and the Village
General liability naming them as additional insured, or a business owners policy that packages liability with property and lost income. A short-term rental needs the hazard and liability insurance the Village's permit asks for, and an event on a Village pavilion needs liability that stands behind the indemnity you sign.
Worth adding
Flood insurance if FEMA's map puts your address in a flood zone, cyber for card payments and client records, employment practices liability once you have staff, and a commercial umbrella above general liability and liquor liability.
By industry
- Restaurants and bars, liquor liability, food trucks and vendors
- Retail shops, salons and barbershops, convenience stores and gas stations
- Contractors and trades (New York's Scaffold Law applies on every roof and facade), landscapers, auto repair shops
- Medical and dental offices, consultants and other professionals, daycare

Common questions
Short answers to what people ask before they call.
Still have a question? Call (518) 902-8822 or book a call.
My building is on Main Street in the facade district. What does that mean for my property insurance?
The Village's facade law covers both sides of Main Street from River Street and Danforth Avenue to Route 145 and Clauverwie and Wells Avenues. It says a facade's historic character is to be kept or restored, with historic materials matched where they can't be kept, and plans for facade changes go to the Joint Planning Board and the Code Enforcement Officer. Rebuilding to those standards after a fire can cost more than an ordinary rebuild, so ask for replacement cost, not actual cash value, and ordinance-or-law coverage for what the rules add to a rebuild.
My shop is near Schoharie Creek. If it floods, am I covered?
Not by a standard commercial property policy; flood is excluded. Schoharie County's hazard mitigation plan says the Village of Middleburgh developed mainly in the Schoharie Creek floodplain, counts Middleburgh among the hardest hit communities in the 2011 flood, and records a state of emergency for the village after flash flooding in June 2013. Flood is a separate policy, through the National Flood Insurance Program or a private carrier, for the building or your improvements and the contents. Business income cover pays only after damage from a covered cause, so ask how each quote treats flood.
I want to run a short-term rental in the village. What insurance does the Village ask for?
Under the Village's Local Law 1 of 2024, short-term rentals are allowed only in the Commercial and Historic districts, and in the Historic district only in owner-occupied buildings. You need a permit from the Code Enforcement Official, renewed each year, with an annual fire and safety inspection. The law asks for proof of hazard and liability insurance suited to the use, kept up to date, and the application asks for the policy's declarations page. A homeowners policy may not cover paying guests, so the rental has to be named on the policy you show the Village.
I'm using a Village pavilion for an event, or selling from a food truck. What do I need?
The Village's pavilion use form covers the Baker Avenue and Timothy Murphy Park pavilions. You agree to defend, indemnify and hold the Village harmless for injuries and damage from your use, alcohol is not allowed on Village property, and where insurance is required it has to be in place before the event. Food trucks have their own Village application to operate a mobile food vehicle. General liability covers the indemnity you sign, and once the policies are in force, I get you the certificates.
Do you meet Middleburgh owners in person?
No. My office is in Clifton Park, and I work with Middleburgh businesses by phone, email and video. Once the policies are in force, I get you the certificates, and audits and claims come through me.
