Business insurance in Troy

Troy's businesses live in old buildings close to the river: restaurants and bars downtown, shops on River Street, salons and studios, and the contractors who keep the city's brick and brownstone standing. Here's what a Troy business usually needs and where the gaps are.

In short

A Troy small business needs workers' compensation from the first employee, part-time student staff included, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. Downtown adds liquor liability for the restaurants and bars under New York's Dram Shop Act, property terms that will actually rebuild a 19th-century commercial building, and flood written as its own policy for businesses on the low streets near the Hudson, which commercial property policies exclude. Contractors working the city's old buildings add the Scaffold Law. I'm a New York property and casualty agent and broker in Clifton Park, quoting Troy businesses across the carriers I represent.

What's different about insuring a business in Troy

  • Restaurants and bars downtown. General liability plus liquor liability under the Dram Shop Act, spoilage and equipment breakdown, and hired and non-owned auto for delivery. See restaurant and bar insurance.
  • Shops on River Street. Leased space in old buildings: the lease sets the liability limits and additional insureds, and your improvements need their own property cover. See retail shop insurance.
  • Old commercial buildings. Brick, cast iron and brownstone cost far more to rebuild than they sell for. Replacement cost and ordinance-or-law coverage are what make a rebuild possible.
  • The Hudson. The river has flooded the low streets downtown and in South Troy. Flood is a separate policy, and sewer backup a separate endorsement.
  • Student staff. RPI, Russell Sage and HVCC students working part-time are employees for workers' comp from the first day.
  • Contractors. The city's old buildings keep a lot of trades busy, with Scaffold Law exposure on every roof and facade. See contractor insurance.
  • Sidewalk outdoor dining. Tables on the sidewalk need a City Clerk permit with a certificate naming the City of Troy as additional insured, liquor liability added if you serve alcohol, a signed indemnity, your County food permit and an SLA temporary extension. Service ends by 10 p.m., and the City can revoke the permit at any time. See liquor liability.
  • Vendors, peddlers and food trucks. Selling on City streets, sidewalks or parks needs a City Clerk permit, a certificate naming the City as additional insured for the whole permit period, and workers' comp and disability proof on Form C-105.2 or a CE-200 exemption; the City won't take a written statement. No vending within 200 feet of a school, firehouse, public building or another business. See food truck and vendor insurance.
  • Festivals, block parties and events. Events on City property need a special event permit at least two weeks ahead, with a certificate naming the City and showing the event's name, date and time, liquor liability if alcohol is served or sold, and an umbrella if the City asks for one. Vendors at the event, Troy businesses included, file their own one-day vendor permits. See commercial umbrella.
  • The historic districts. Exterior changes to a building in one of Troy's historic districts need Historic District and Landmark Review Commission review and Planning Department approval before work starts. Replacing a window or door needs a building permit, and ladders or scaffolds in the right-of-way generally need a barricade permit. A rebuild after a loss goes through the same review; see commercial property insurance.

Questions

Common questions

Short answers to what people ask before they call.

Still have a question? Call (518) 902-8822 or book a call.

What insurance does a restaurant or bar in downtown Troy need?

General liability and liquor liability, because general liability excludes Dram Shop claims and landlords require both; workers' compensation for every employee from the first day, and DBL and Paid Family Leave once someone has worked 30 days in a calendar year; property for your equipment and improvements, with spoilage for the walk-in; and hired and non-owned auto if anyone delivers. The restaurant page goes through each.

My shop is near the river. If the Hudson floods downtown, am I covered?

Not by a standard commercial property policy; flood is excluded. You need a separate flood policy, through the National Flood Insurance Program or a private carrier, for the building or your improvements and the contents. Lost income is the harder part: business income cover usually pays only after physical damage from a covered cause, so ask how each quote treats flood before you rely on it.

I hire students part-time. Do they need workers' comp?

Yes. Part-time and seasonal employees are employees under New York law, and workers' compensation covers them from the first day. DBL and Paid Family Leave apply once someone has worked for you 30 days in a calendar year, which a semester-long hire usually reaches.

My building is over a hundred years old. What should the property policy say?

Replacement cost rather than actual cash value, a limit based on what it costs to rebuild that building today rather than its sale price, and ordinance-or-law coverage for the code upgrades a partial rebuild triggers. If you rent, make sure the improvements you paid for are covered; the landlord's policy usually doesn't cover them.

I want tables on the sidewalk outside my Troy restaurant. What does the City want?

A sidewalk outdoor dining permit from the City Clerk, applied for at least 14 days before you plan to open. With it you file a certificate of insurance naming the City of Troy as additional insured, with liquor liability added if you serve or sell alcohol; a map of the sidewalk space; your Rensselaer County Health Department food permit; and the SLA temporary extension form, since your liquor license only extends to space next to your property. You also agree to indemnify and hold the City harmless. Outdoor service ends by 10 p.m., you keep a clear path for pedestrians, and the City can revoke the permit at any time. Once the policies are in force, I get you the certificate.

Are you in Troy?

My office is in Clifton Park. I meet Troy owners at their business, at the office or by phone, and handle certificates, audits and claims myself afterward.
