Business insurance in Windham

Windham's Town government describes a resort destination whose economy depends on tourism: a ski resort that is the Town's largest employer, a summer bike park, and the inns, restaurants and shops on Main Street and in the hamlets. Here's what a Windham business needs, and the Town and County rules that change it.

In short

A Windham small business needs workers' compensation from the first employee, seasonal staff included, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. The Town describes an economy that depends on tourism, with lodging, restaurants and the ski resort at its center, so liquor liability and short-term rental cover matter. Outdoor dining and food trucks need a Planning Board permit, and contractors file certificates of insurance and workers' comp with each building permit. Main Street flooded in Irene, and commercial property excludes flood. My office is in Clifton Park, and I work with Windham businesses by phone, email and video.

What's different about insuring a business in Windham

  • Lodging and restaurants. The Town's comprehensive plan says the local economy relies heavily on lodging, from hotels, motels, inns and bed and breakfasts to short-term rentals, and its zoning law calls Windham a resort destination dependent on tourism. Inns and restaurants that serve alcohol need liquor liability under the Dram Shop Act; see restaurant and bar insurance and business owners policies.
  • Winter and summer seasons. The plan names Windham Mountain, the ski resort, as the Town's largest employer, with a bike park drawing summer visitors. Seasonal hires are covered by workers' comp from the first day, and DBL and Paid Family Leave follow once someone has worked 30 days in a calendar year.
  • Outdoor dining and food trucks. Sidewalk cafes, outdoor tables and food and beverage trucks need a Planning Board permit, renewed yearly for trucks, and peddlers need a Town Clerk licence. See food truck insurance.
  • Contractors and trades. Every contractor on a Town building permit files a certificate of insurance and workers' comp, and electricians need a County licence with proof of liability insurance. See contractor insurance; roofs and work at height carry Scaffold Law exposure.
  • Events on Town property. Using a Town facility means naming the Town as primary, unrestricted additional insured, with a certificate in hand before the event. See general liability.
  • Short-term rentals and alarms. Greene County asks owners to register short-term rentals, and the Town requires alarm systems to be registered with the Town Clerk, with fees for repeated false alarms. See landlord and short-term rental insurance.
  • The Batavia Kill. Main Street sits where the Batavia Kill meets Mad Brook. Irene flooded Route 23 in 2011 and destroyed three businesses, and the 1960 flood damaged 27. Commercial property excludes flood; flood insurance is a separate policy.

What Windham businesses carry

Required by New York

Workers' compensation from the first employee, part-time and seasonal staff included, and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Business vehicles need commercial auto.

Required by your landlord, clients and the Town

General liability naming them as additional insured, with the wording a lease, contract or Town agreement asks for, or a business owners policy that packages liability with property and lost income for a shop, inn or small restaurant. A sole proprietor trading under an assumed name files a business certificate with the County Clerk; the Greene County page covers it.

Worth adding

Flood insurance if FEMA's map puts your address in a flood zone, cyber for card payments and online bookings, employment practices liability once you have staff, inland marine for rental gear and tools that leave the premises, and a commercial umbrella above general liability and liquor liability.

Questions

Common questions

Short answers to what people ask before they call.

Still have a question? Call (518) 902-8822 or book a call.

I want outdoor tables, or to run a food truck, in Windham. What do I need?

A permit from the Planning Board under the Town's Zoning Law. It covers outdoor dining of any kind, sidewalk cafes and food and beverage trucks; you apply in writing on a form from the Town Clerk, and the Board can attach conditions. A permit tied to a permanent business, such as an inn or restaurant, carries on while you follow those conditions, but a food truck or transient business renews every year. Peddlers need a separate licence from the Town Clerk. Make sure your general liability covers the outdoor area and the truck's operations, and add liquor liability if you serve alcohol outside.

I'm a contractor working in Windham. What will the Town ask for?

The Town's building permit application asks for a certificate of insurance and workers' comp from every contractor on the job, listed trade by trade. Electricians also need a Greene County licence, which requires proof of liability insurance, and the County tells owners to check for an active licence and the required insurance before hiring. Once the policies are in force, I get you the certificates; any work at height carries Scaffold Law exposure.

We're holding an event on Town property. What insurance does the Town want?

The Town's use-of-facility agreement asks you to hold the Town harmless and name it as an unrestricted additional insured on your policies, other than workers' comp, on a primary basis, using endorsement CG 20 26 or broader, with 30 days' notice of cancellation. The certificate has to reach the Town before the work or the use starts, and the form sets the general liability limits. I check that the policy and the certificate say exactly that before you send it.

My business is on Main Street near the Batavia Kill. If it floods, am I covered?

Not by a standard commercial property policy; flood is excluded. The Town's comprehensive plan says Main Street sits where the Batavia Kill meets Mad Brook and has flooded since the 1860s, and that Irene in 2011 left four to six feet of water along Route 23 and destroyed three businesses. The County's hazard plan records 27 businesses damaged in the 1960 flood. Flood is a separate policy, through the National Flood Insurance Program or a private carrier, and business income pays only after damage from a covered cause, so ask how each quote treats flood.

Do you meet Windham owners in person?

No. My office is in Clifton Park, and I work with Windham businesses by phone, email and video. Once the policies are in force, I get you the certificates, and audits and claims come through me.
