Business insurance in Athens
Athens is a town and village on the west bank of the Hudson, where the historic downtown on Second and Water Streets holds the shops, restaurants and offices, and the Town has an industrial park with gas and rail access. Here's what an Athens business needs, and the Town and Village rules that change it.
An Athens small business needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. In the Village, contractors pulling a building permit prove workers' comp and disability coverage on the State's forms, since ACORD certificates are not accepted, and exterior work in the Historic District needs a Planning Board permit first. The Town and the Village each regulate short-term rentals, and federally mapped floodplain runs along the Hudson shoreline and Murderer's Creek, which commercial property policies exclude. My office is in Clifton Park, and I work with Athens businesses by phone, email and video.
What's different about insuring a business in Athens
- Downtown on Second and Water Streets. The Town and Village plan calls the Village's historic downtown the hub of business activity, with stores, restaurants and professional offices, and wants more small businesses on the waterfront. Your lease sets the liability limits and additional insureds, and your stock and improvements need their own property cover. See retail shop insurance, restaurants and bars and business owners policies.
- Historic buildings. The Town counts more than 300 buildings on national and state historic registers, and the Lower Village and Brick Row Historic Districts are on both. In the Village, exterior work in the Historic District needs a Planning Board permit before a building permit. Replacement cost and ordinance-or-law coverage are what make a rebuild possible; see commercial property insurance.
- Contractors and electricians. A Village building permit wants State forms for workers' comp and disability, not ACORD certificates, from the contractor and every subcontractor, and electrical work by a licensed electrician. See contractor insurance and certificate requests; work at height carries Scaffold Law exposure.
- Short-term rentals in the Town and the Village. Each has its own rules: the Village inspects every unit for fire safety each year and renews permits each January, and the Town issues a one-year certificate after a fire and safety inspection, with a 24-hour contact and occupancy limits in every listing. See landlord and short-term rental insurance.
- The industrial park. The plan describes a Town industrial park with gas and rail access. Plants and warehouses need business income, inland marine for equipment that moves, and trucking or commercial auto for the fleet.
- The Hudson and Murderer's Creek. Federally designated floodplain runs along the whole Hudson shoreline and Murderer's Creek below the dam, and the County's hazard plan records the 1996 Hudson flood that damaged Athens Riverfront Park and marinas. The Village's flood guide warns that boats stored ashore in low areas can be shifted and damaged. Commercial property excludes flood; flood insurance is a separate policy.
What Athens businesses carry
Required by New York
Workers' compensation from the first employee, part-time and seasonal staff included, and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Permits need proof of both. Business vehicles need commercial auto.
Required by your landlord, clients and the Village
General liability naming them as additional insured, with the wording a lease or contract asks for, or a business owners policy that packages liability with property and lost income for a shop, office or small restaurant. A sole proprietor trading under an assumed name files a business certificate with the County Clerk; the Greene County page covers it.
Worth adding
Flood insurance if FEMA's map puts your address in a flood zone, liquor liability under the Dram Shop Act for restaurants and bars that serve, cyber for card payments and online bookings, employment practices liability once you have staff, and a commercial umbrella above general liability and auto. Vendors at the July street festival or the summer music nights at Riverfront Park should ask the organizer what certificate they need; see food truck and vendor insurance.
By industry
- Restaurants and bars, liquor liability, shops and galleries, salons
- Contractors and electricians, handyman services, landscapers
- Trucking, equipment and boats in your care, warehouses and plants
- Short-term and long-term rentals, cleaning services that turn them over

Common questions
Short answers to what people ask before they call.

I'm a contractor pulling a Village of Athens building permit. What insurance proof do they want?
The Village's building permit application asks a business or general contractor for State proof of workers' compensation and disability coverage: the carrier's C-105.2 or the State Insurance Fund's U-26.3 for comp, with a DB-120.1 or DB-820/829 for disability, or a CE-200 exemption. It says ACORD forms are not acceptable proof of either, and subcontractors must also provide proof of insurance, disability and workers' compensation. Electrical work goes to a licensed electrician and is inspected by a Greene County approved inspector. Once the policies are in force, I get you the certificates; work at height carries Scaffold Law exposure.
My building is in the Village's Historic District. What changes?
Exterior work needs a Historic District Work Permit approved by the Village Planning Board before the Code Enforcement Office can issue a building permit, with paint swatches, material samples, a scaled drawing and photos of the building. A rebuild after a fire goes through the same review, so the property policy should be written at replacement cost with ordinance-or-law coverage, and business income should allow for the extra time. If you rent, make sure the improvements you paid for are covered.
I rent a place to guests in Athens. Which rules apply?
It depends on which side of the Village line you are. In the Village, short-term rental units register with the Village, have a fire inspection by the Code Enforcement Officer every year under Local Law 3 of 2024, list an emergency contact, and renew each January. In the Town, Chapter 147 covers stays of eight days or less: a registration certificate from the Town Clerk before anyone stays, a fire and safety inspection before it is issued, a renewal every year, a 24-hour contact posted in the unit, the occupancy limits in every listing, and an agent or local contact living in Greene County if you live outside it. Greene County also asks owners to register. A homeowners policy can limit or exclude paying guests, so the rental needs a policy written for it.
My business is near the river or Murderer's Creek. If it floods, am I covered?
Not by a standard commercial property policy; flood is excluded. The Town and Village plan maps federally designated floodplain along the whole Hudson shoreline, Murderer's Creek below the dam and Potic Creek, and the County's hazard plan records Hudson flooding in January 1996 that forced evacuations in Athens and damaged Athens Riverfront Park and marinas. Flood is a separate policy, through the National Flood Insurance Program or a private carrier. Business income cover pays after physical damage from a covered cause, so ask how each quote treats flood before you rely on it.
Do you meet Athens owners in person?
No. My office is in Clifton Park, and I work with Athens businesses by phone, email and video. Once the policies are in force, I get you the certificates, and audits and claims come through me.
