Business insurance in Marlboro, Milton and the Town of Marlborough
The Town of Marlborough lies between the Hudson and the Marlboro Mountains, split north to south by Route 9W, a farming town whose plan counts tourism, agriculture, hospitality and commercial and industrial development among its economic drivers. Here's what a Marlboro or Milton business needs, and the Town rules that change it.
A Marlboro or Milton small business needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. The Town of Marlborough sets the local rules: a commercial building permit needs compensation and liability insurance on file, a road cut needs a certificate naming the Town as additional insured, and short-term rentals and farm venue events go through Planning Board review. The hamlets flood in heavy rain, and commercial property policies exclude flood. My office is in Clifton Park, and I work with Marlboro and Milton businesses by phone, email and video.
What's different about insuring a business in Marlboro and Milton
- Hamlets, so the Town sets the rules. Marlboro, Milton and Lattintown are hamlets of the Town of Marlborough, in the southeastern corner of Ulster County, so permits and inspections go through the Town at 21 Milton Turnpike in Milton. The county's hazard plan says the Town's Economic Development Committee is focused on the economic future of the hamlet of Marlboro.
- The Route 9W corridor. The Town Code describes Route 9W as the road that splits the town north to south, parallel to the Hudson, and as the home of mixed residential, commercial and light industrial uses. Its Business Corridor Overlay District lets existing commercial, office and light industrial buildings on 9W in residential and rural districts be put back to business use, by petition to the Town Board and then Planning Board review. Changing a building's use changes what the property and liability policies need to say; see commercial property insurance and business owners policies.
- Orchards, farm venues and visitors. The county's hazard plan says farming has been part of the town throughout its history and lists tourism, agricultural development, arts and entertainment, and hospitality among the economic drivers in the Town's plan; the Town's own letterhead calls it the heart of the Hudson Valley fruit section. Farm venue events, B&Bs, short-term rentals and home occupations go through Planning Board minor site plan review. Paying guests and events need general liability, and liquor liability under the Dram Shop Act if alcohol is served; see landlord and short-term rental insurance.
- Contractors and Town permits. The commercial building permit isn't released until compensation and liability insurance, or a New York comp waiver, is on file, along with a list of subcontractors. A road cut on a Town road needs a certificate listing the Town of Marlborough as additional insured on a primary basis. See contractor insurance and workers' compensation; work at height carries Scaffold Law exposure.
- Flooding in the hamlets. The hazard plan says the Town's only mapped flood plain is near the Hudson, where there are no residences, yet the hamlets of Marlboro and Milton flood consistently in heavy rain, and the Town has four repetitive loss and one severe repetitive loss properties. Commercial property excludes flood; flood insurance is a separate policy, and FEMA's map is only part of the picture.

Common questions
Short answers to what people ask before they call.
Still have a question? Call (518) 902-8822 or book a call.
I'm a contractor pulling a commercial building permit in Marlborough. What insurance does the Town want?
The Building Department's commercial permit checklist asks whether you've submitted compensation and liability insurance, or a New York workers' comp waiver, and says it must be completed and returned before the permit is released. It also asks for a list of subcontractors with names, addresses and phone numbers. Once the policies are in force, I get you the certificates and request the workers' comp and disability forms from your carriers.
I'm cutting into a Town road for a driveway or utility line. What does the Highway Department need?
The Highway Department's Road Cut Application, made under Town Code section 130-14.15, requires the contractor or person doing the work to give the Town a certificate of insurance listing the Town of Marlborough as additional insured on a primary basis, with liability and property damage insurance at the minimum the form sets. Restoring the road is the applicant's responsibility, and the Highway Superintendent has to be told before work starts.
I want to rent my place to visitors or host events on my farm. What does the Town require?
Short-term rentals, home occupations, bed and breakfasts and farm venue events go to the Planning Board as a minor site plan application under the Town Code, sections 155-31 O, 155-32.3 and 155-23 among them, with notice by certified mail to property owners within 500 feet. Short-term rentals also have permit and safety inspection requirements in section 155-32.3, handled by the Building Department after Planning Board approval. A homeowners or farm policy often limits paying guests and events, so the rental or venue needs cover written for it.
My business is in Marlboro or Milton. If it floods, am I covered?
Not by a standard commercial property policy; flood is excluded. The Town's section of the county's 2024 hazard plan says the hamlets of Marlboro and Milton have consistent flooding during heavy rain, even though the Town's only mapped flood plain is near the Hudson, where there are no residences, and it counts four repetitive loss and one severe repetitive loss properties. Flood is a separate policy, through the National Flood Insurance Program or a private carrier, and business income pays only after damage from a covered cause, so ask how each quote treats flood.
Do you meet Marlboro and Milton owners in person?
No. My office is in Clifton Park, and I work with Marlboro and Milton businesses by phone, email and video. Once the policies are in force, I get you the certificates, and audits and claims come through me.
