Business insurance in Fishkill and East Fishkill
The Town of Fishkill, the Village of Fishkill and the Town of East Fishkill each set their own permit rules, and several of them spell out the insurance they want. Here's what a business in any of the three needs, and the local rules that change it.
A small business in Fishkill or East Fishkill needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. Locally, a Town of Fishkill peddler or food truck licence needs certificates naming the Town as additional insured and a Fire Inspector operating permit for cooking equipment, East Fishkill wants liability and workers' comp proof from every contractor before a permit, and bars and dance halls in the Village of Fishkill need a cabaret licence. My office is in Clifton Park, and I work with Fishkill businesses by phone, email and video.
What's different about insuring a business in Fishkill and East Fishkill
- Food trucks and peddlers. A Town of Fishkill peddler or solicitor licence, under Town Code Chapter 112, needs certificates naming the Town as additional insured on general and auto liability, primary and non-contributing, an umbrella, workers' comp and disability on State forms, and a hold harmless agreement. A truck with grills or fryers needs a Fire Inspector operating permit under the State's Part 1203 rules, with a hood, an automatic extinguishing system and regular hood cleaning. The Village of Fishkill issues its own vendor permit under Village Code Chapter 111, and East Fishkill requires door-to-door vendors to register with the Town Clerk. See food truck insurance and commercial auto.
- Contractors and permits. East Fishkill wants proof of liability and workers' comp from every contractor at application, with the Town as certificate holder and comp on State forms, not an ACORD. In the Town of Fishkill, commercial work needs stamped plans, and a road opening permit needs a surety bond and an agreement to hold the Town harmless. See contractor insurance; work at height carries Scaffold Law exposure.
- Opening or changing a business. In East Fishkill, any change of use or tenant in an existing building goes on a New Business or Change of Use form, where a building permit and certificate of occupancy are required the space stays empty until the certificate is issued, and the Fire Advisory Board's site plan requirements include a monitored fire alarm and a Knox key box. In the Town of Fishkill, home occupations and signs take Zoning permits. See business owners policies and commercial property.
- Bars, cabarets and gatherings in the Village. The Village of Fishkill licenses places of public assembly operating as a cabaret, bar or lounge, dance hall or discotheque, and its Fire Inspector inspects public assembly areas. It also has a seasonal sidewalk café licence and a mass gathering permit. See restaurant insurance and liquor liability under the Dram Shop Act.
- Alarms. The Town of Fishkill Police keep a Commercial Business Alarm Registry of alarm companies, managers and keyholders, and the Village of Fishkill issues alarm user permits that expire each year. The registry asks you to tell the police about any change immediately, so keep keyholders and the alarm company current.
- Rooms for guests. The Town of Fishkill posts its own hotel occupancy tax registration form, separate from the County's. A short-term rental needs a policy written for paying guests; see landlord insurance.
- Fishkill Creek. The county's hazard plan names the lower Fishkill Creek among its most flood-damage-prone floodplains, records ice jams on the creek at Hopewell Junction, and estimates that the Village of Fishkill would see the greatest impact on its population of any Dutchess municipality in a 1-percent annual chance flood. The Town of Fishkill requires a Floodplain Development Permit, and East Fishkill's part in FEMA's Community Rating System gives flood policyholders there a discount. Commercial property excludes flood; flood insurance is a separate policy.

I want to run a food truck or sell door to door in the Town of Fishkill. What insurance do they want?
The Town Clerk's peddler and solicitor application, under Town Code Chapter 112, goes to the Town Board for new licences. It asks for a Dutchess County Health Department permit if you handle food, a notarized letter from the owner of any private property you use, a signed hold harmless agreement, and certificates of insurance meeting the Town's requirements: general liability, auto liability and an umbrella at the limits printed on the form, with the Town named as additional insured on the general and auto liability on a primary, non-contributing basis, plus workers' compensation and disability on State forms or a CE-200 exemption. A truck with grills or fryers also needs an operating permit from the Town's Fire Inspector. Once the policies are in force, I get you the certificates.
I'm a contractor pulling permits in East Fishkill. What proof of insurance do I need?
The Town of East Fishkill asks every contractor for proof of liability insurance and workers' compensation, or an exemption, at the time of application, naming the Town as certificate holder with the Town's address. Liability can be on an ACORD form; workers' compensation has to be on New York State forms such as the C-105.2, as the Town notes General Municipal Law §125 requires, and an exempt applicant files a new CE-200 for each permit. Once the policies are in force, I get you the certificates.
I'm opening a bar or a place with live music in the Village of Fishkill. What do I need?
The Village licenses places of public assembly operating as a cabaret, bar or lounge, dance hall or discotheque, and the application asks for the owners, the premises, the landlord if you lease, and, if you don't live in the Village, a local agent to accept notices. The Village's Fire Inspector inspects public assembly areas. You also need liquor liability under the Dram Shop Act alongside general liability, and the restaurant and liquor liability pages go through the rest.
My business is near Fishkill Creek. Is flood covered?
Not by a standard commercial property policy; flood is excluded. Dutchess County's FEMA-approved hazard mitigation plan names the lower Fishkill Creek, where development has occurred, among the floodplains most susceptible to severe damage, records ice jams on Fishkill Creek, including one at Hopewell Junction, and estimates that the Village of Fishkill would see the greatest impact on its population of any municipality in the county in a 1-percent annual chance flood. Flood is a separate policy, and East Fishkill takes part in FEMA's Community Rating System, which gives flood policyholders there a discount.
Do you meet Fishkill owners in person?
No. My office is in Clifton Park, and I work with Fishkill businesses by phone, email and video. Once the policies are in force, I get you the certificates, and audits and claims come through me.
