Business insurance in Red Hook and Tivoli

The Town of Red Hook takes in the Village of Red Hook and the Village of Tivoli, each with its own building office, and the Town's own history puts farming, dairying and fruit growing at the base of its economy. Here's what a Red Hook business needs, and the local rules that change it. My office is in Clifton Park, and I work with Red Hook businesses by phone, email and video.

In short

A Red Hook small business needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. The Town asks for workers' comp, disability and liability certificates naming the Town of Red Hook with a building permit. Short-term rentals and farm stays need an annual Town permit, and events and parties are not allowed in them. Food trucks need a Town permit and a County health permit, and large gatherings need Town Board approval and a liability policy naming the Town. My office is in Clifton Park, and I work with Red Hook businesses by phone, email and video.

What's different about insuring a business in Red Hook

  • Short-term rentals and farm stays. Every short-term rental in the Town, hosted, un-hosted or farm stay, needs an annual operating permit; events, parties and weddings are not allowed in them, guests need detectors, extinguishers and two ways out of each bedroom, and you show you paid the County's hotel occupancy tax. A homeowners policy often limits paying guests; see landlord and short-term rental insurance.
  • Farms and orchards. The Town's history puts farming, dairying and fruit growing at the base of its economy for 150 years, and its rental law has a farm stay category of its own. A farm that takes in overnight guests or sells to the public needs liability that covers them; see general liability, liquor liability and inland marine for equipment that moves.
  • Contractors and Town permits. A Town building permit needs workers' comp, disability and liability certificates naming the Town of Red Hook as certificate holder, or an exemption affidavit; the two villages have their own building inspectors. See contractor insurance; every roof and facade also carries Scaffold Law exposure.
  • Food trucks. The Town's food truck permit needs a County health permit, the property owner's consent and a site sketch under Chapter 79. See food truck insurance and commercial auto.
  • Large events. A gathering above the Chapter 44 thresholds needs Town Board approval and a liability policy naming the Town as additional insured before any tickets are sold, and alcohol only under a temporary state license. See liquor liability under the Dram Shop Act and commercial umbrella.
  • Opening in the Village of Red Hook. The Village has its own Building & Zoning Department at Village Hall, 7467 South Broadway, with sign, special permit and site plan applications, an "Opening a New Business" flow chart and a New Business Guide. Your lease sets the liability limits and additional insureds; see retail shop insurance, restaurant and bar insurance and business owners policies.

Questions

Common questions

Short answers to what people ask before they call.

Still have a question? Call (518) 902-8822 or book a call.

I rent out a room or a cottage in Red Hook. What does the Town require?

An annual operating permit for every short-term rental, hosted, un-hosted or farm stay, under Chapters 112 and 143 of the Town Code. Except for a farm stay, it has to be on the parcel that is your primary residence. Events, parties, weddings and meetings are not allowed, and no meals beyond a bed-and-breakfast-style meal for the guests. You certify working smoke and carbon monoxide detectors, a fire extinguisher on each floor and two ways out of each guest bedroom, attach proof that you paid the County's hotel occupancy tax, and name a local contact who can respond within an hour when you're away. A homeowners policy often limits or excludes paying guests, so the rental needs cover written for it.

I'm a contractor pulling a building permit from the Town. What insurance proof does it want?

The Town's list of documents required for a building permit includes workers' compensation, disability and liability insurance certificates with the Town of Red Hook named as certificate holder, or the affidavit of exemption where it applies. The Village of Red Hook and the Village of Tivoli each have their own building inspector, so a job inside a village goes through that village's office; ask it what it wants on the certificate. Once the policies are in force, I get you the certificates.

I want to park a food truck in Red Hook. Do I need a permit?

Yes. The Town's food truck permit application asks for a description and photo of the truck with its plate, VIN and dimensions, a valid Dutchess County Department of Health permit for mobile food service, the property owner's consent, and a sketch plan showing the spot complies with Chapter 79 of the Town Code. There are seasonal and short daily permits, signed by the Zoning Enforcement Officer, and they are not transferable. The truck itself needs commercial auto, and a property owner or event can ask for your general liability certificate.

I'm organizing a large event in Red Hook. What insurance does the Town want?

A gathering of more than 1,000 people, or more than 500 for more than eight hours, needs a Town Board permit under Chapter 44, and no tickets can be sold before preliminary approval. No event is held until the organizer gives the Town a liability policy from a company licensed in New York, insuring the organizer and the property owner, naming the Town as additional insured and not cancelable without prior written notice to the Town, with a certificate and a copy of the policy. Alcohol can be sold only under a temporary state license, and the Board can require a bond. Liquor liability under the Dram Shop Act comes with it.

Do you meet Red Hook owners in person?

No. I'm based in Clifton Park and meet people in person across six counties. Red Hook is outside them, so I work with Red Hook businesses by phone, email and video. Once the policies are in force, I get you the certificates, and audits and claims come through me.
