Business insurance in Millbrook
The Village of Millbrook, in the Town of Washington, describes itself through its historic charm, local shops, cultural attractions and the countryside around it. Here's what a Millbrook business needs, and the Village rules that change it.
A Millbrook small business needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. A restaurant with tables on a Village sidewalk needs a seasonal permit from the Building Inspector, with a certificate naming the Village as additional insured on a primary, noncontributory basis. An event needs a Mayor's permit with liability insurance naming the Village and Dutchess County. Short-term rentals need a Village permit, capped each year, with property and liability insurance rated for short-term rental. My office is in Clifton Park, and I work with Millbrook businesses by phone, email and video.
What's different about insuring a business in Millbrook
- A historic village center. The Village describes its historic charm, traditional streetscape and architectural heritage, with local shops and cultural attractions, and the Town of Washington describes a center of locally owned shops, cafes and restaurants. Your lease sets the liability limits and additional insureds; older buildings need replacement cost and ordinance-or-law coverage. See retail shop insurance, business owners policies and commercial property.
- Sidewalk dining. A seasonal Village permit, April 1 to November 1, issued only after you show workers' comp and employers' liability and general liability naming the Village as additional insured, primary and noncontributory, with a waiver of subrogation. Serving alcohol outside needs State approval and adds liquor liability under the Dram Shop Act; see restaurant and bar insurance.
- Events and gatherings. A Mayor's permit, applied for 30 days ahead, with liability insurance primary to the Village's and naming both the Village and Dutchess County as additional insured. Caterers and vendors working the event should have their own certificates ready; see food truck insurance.
- Short-term rentals. Only in your primary residence, with no more than fifteen Village permits a year, a yearly inspection, and property and liability insurance showing the home is rated for short-term rental. See landlord and short-term rental insurance.
- Building and sign permits. Construction, alteration, demolition, roofs, electrical, plumbing and HVAC work need a Village building permit, signs need their own permit, and every permit needs proof of workers' comp and DBL coverage. See contractor insurance; roof and facade work carries Scaffold Law exposure.
- Flood. The Village has a Flood Damage Prevention law and links FEMA's flood map for Millbrook. Commercial property excludes flood; check your address, and if it is in a flood zone, flood insurance is a separate policy.

I want tables on the sidewalk outside my restaurant. What does the Village want?
An Outdoor Dining Area Permit from the Village Building Inspector. It covers Village sidewalks only, not streets, lasts one season, so you apply each year, and outdoor dining runs from April 1 to November 1, with tables cleared and stored indoors by 10 p.m. and no music. Serving alcohol outside needs State Liquor Authority approval, drinks are made inside and served only to seated patrons. Before the permit is issued you show workers' compensation and employers' liability, and general liability at the limits the Village sets, with the Village named as additional insured, a waiver of subrogation, coverage primary and noncontributory, and 30 days' notice of cancellation. You also agree to indemnify the Village and pay for any damage to the sidewalk. Once the policies are in force, I get you the certificate.
I'm organizing an event or gathering in the village. What insurance does it need?
Under the Village Code, a public gathering, parade or motorcade needs a permit from the Mayor, applied for at least 30 days ahead. The application asks for comprehensive liability insurance designated as primary to the Village's own, naming the Village of Millbrook and Dutchess County as additional insured, and the certificate has to reach the Village before the permit is issued. The form also asks you to list every caterer, sound technician, tent and booth, so vendors and contractors should be ready with their own certificates.
I want to rent my house or apartment to visitors. What does the Village require?
A Village short-term rental permit under Local Law 2 of 2024. The rental has to be your primary residence, the Village issues no more than fifteen permits a year with a waitlist after that, and a permit lasts two years. The Code Enforcement Officer inspects every year before a permit is issued, no more than six guests stay at a time, the permit number goes in every listing, and you or your agent must be able to respond in person within one hour. You also provide evidence of property hazard insurance and a certificate of liability insurance showing the premises is rated for short-term rental, and keep both in force for the whole permit. Bed and breakfasts and inns are regulated separately under the zoning code.
I'm a contractor working in the village. What do I need?
A Village building permit for construction, alteration or demolition, including roof replacements and electrical, plumbing and HVAC work, and a sign permit, permanent or temporary, for any new sign. New York requires the permit office to see proof of workers' compensation and disability and Paid Family Leave coverage before a permit is issued. Owners and general contractors will also ask for general liability naming them as additional insured; the contractor page goes through each.
