Business insurance in Berne and Knox

Berne and Knox are Albany County towns. The Town of Berne's plan describes a rural Hilltown of farmland, woods and hamlets, and looks to farms, agri-businesses and small local firms for its economy. Here's what a business here needs, and what each town asks for before a permit.

In short

A Berne or Knox business needs workers' compensation from the first employee, DBL and Paid Family Leave after 30 days of work in a calendar year, general liability, and commercial auto. A Berne building permit asks for general liability with the Town added and current workers' comp and disability certificates, not ACORD forms. Berne requires an operating permit for places of assembly holding 100 or more people; Knox requires a Town Board permit and a bond for gatherings expected to exceed 500. Farms adding u-pick, hay rides or a bed and breakfast need each activity named on the policy. My office is in Clifton Park; I meet owners at their business, at the office or by video.

What's different about insuring a business in Berne and Knox

  • Farms and agri-businesses. The Town of Berne's 2017 plan describes a rural Hilltown dominated by farmland and woods, and looks to farms, agri-businesses and small local firms for its economy. A farm that sells to the public, hires seasonal help or runs equipment on the road needs each of those named: general liability for visitors, workers' comp from the first hire, and inland marine for machinery that moves between fields.
  • Agri-tourism and bed and breakfasts. The plan encourages u-pick, hay rides and bed and breakfasts. Paying visitors on a farm, or guests in a converted farmhouse, need liability written for that use; see landlord and short-term rental insurance.
  • Event barns and gatherings. Berne requires an operating permit, after an inspection, for any place of public assembly holding 100 or more people. Knox requires a Town Board permit and a bond for gatherings expected to exceed 500, and no outdoor amplified sound after 10 p.m. Events that serve alcohol add liquor liability under the Dram Shop Act.
  • Contractors pulling Berne permits. The Town wants proof of general liability with the Town of Berne added, and current workers' comp and disability certificates on file, not ACORD forms. Work in a town, county or state road needs its own permit; the Albany County Department of Public Works issues permits for new work in county highway rights-of-way. See contractor insurance and certificate requests; work at height carries Scaffold Law exposure.
  • The Berne hamlet's historic district. The Planning Board approves exterior construction, alteration, repair, demolition or moving of a building in the Town's Historic District before a building permit. Replacement cost and ordinance-or-law coverage make that rebuild possible; see commercial property insurance.
  • Junk yards, salvage and hazardous materials. Berne's operating permit also covers waste handling such as junk yards and auto dismantling, combustible dust from commercial work, and hazardous materials above Fire Code limits. In Knox, vacant buildings, commercial ones included, are registered with the Town within 15 days of its notice. See auto repair shops.

What Berne and Knox businesses carry

Required by New York

Workers' compensation from the first employee, seasonal farm and event help included, and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Permits need proof of both. Business vehicles need commercial auto.

Required by your landlord, clients and the towns

General liability naming them as additional insured, with the Town of Berne added for a building permit there, or a business owners policy that packages liability with property and lost income for a shop, office or small restaurant. County filings, such as a DBA with the County Clerk, are on the Albany County page.

Worth adding

An equipment floater for tractors and tools, liquor liability for any event or restaurant that serves, cyber for card payments and online bookings, employment practices liability once you have staff, and a commercial umbrella above general liability and auto. Flood insurance is separate from property cover; Knox has a flood damage prevention law, and FEMA's map shows whether your address is in a flood zone.

How I quote a Berne or Knox business

A short conversation about everything the business does, from the barn and the fields to the shop counter, and what your lease, contracts and permits require; then quotes from several carriers with what each leaves out, side by side. Once you choose and the policies are in force, I get you the certificates for your landlord, your clients or the Town. My office is in Clifton Park; I meet owners at their business, at the office or by phone or video, and audits and claims come through me afterward. The business gap check takes three minutes. Questions

Common questions

Short answers to what people ask before they call.

Still have a question? Call (518) 902-8822 or book a call.

I'm a contractor pulling a Town of Berne building permit. What insurance proof do they want?

The Town's application asks for proof of general liability insurance with the Town of Berne added as a rider, and proof of workers' compensation insurance or an exemption. Its notices say no permit is issued unless current workers' compensation and disability certificates are attached or already on file, and that ACORD forms are not acceptable proof of workers' comp; the permit guidelines say the same for contractors' liability and comp certificates. The permit also gives no right to work in a Town, County or State road, which needs its own permit. Once the policies are in force, I get you the certificates.

I want to host weddings or events in a barn. What do the towns require?

In Berne, an operating permit is required for any place of public assembly with an occupant load of 100 or more, issued after an inspection of fire protection, exits and occupancy, with periodic inspections after that. In Knox, the Town's Public Assembly Ordinance requires a written Town Board permit for any gathering expected to exceed 500 people, applied for at least 20 days ahead, with a bond protecting the Town and property owners against damage, and no amplified sound outdoors after 10 p.m. Insurance-wise, a farm policy may not cover a paying event business on its own: you need general liability for the events, liquor liability if alcohol is served or sold, and property cover for the barn at what it would cost to rebuild.

My farm is adding u-pick, hay rides or a bed and breakfast. What changes?

Each new activity has to be named on the policy. The Town of Berne's comprehensive plan encourages exactly these uses, from u-pick and hay rides to bed and breakfasts, but a farm policy written for crops and livestock can exclude visitors who pay to be on the property. Tell every carrier what the public does on the farm, and add workers' compensation for seasonal help from the first day.

I own a vacant commercial building in Knox. Does the town care?

Yes. Under Knox Local Law 3 of 2018, once the Building and Zoning Administrator finds a structure vacant, residential or commercial, the owner registers it with the Town within 15 days of the notice, giving a contact number, a residence or place of business, and any property maintenance contractor. Broken windows, unsecured doors and debris are prohibited conditions. Vacancy matters to your insurance too: some property policies restrict cover once a building sits empty, so tell me before it does.

Do you meet Berne and Knox owners in person?

Yes. My office is in Clifton Park; I meet owners in Berne, East Berne and Knox at their business, at the office or by phone or video. Once the policies are in force, I get you the certificates, and audits and claims come through me.
