Business insurance in Ballston Spa

Ballston Spa is the Saratoga County seat: a village settled in 1771, with a Central Business District that has its own sidewalk rules, the County Clerk on McMaster Street and the county fairgrounds on Prospect Street. Here's what a business here needs and what the village, the county and the fair ask for.

In short

A Ballston Spa small business needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. The Village of Ballston Spa adds its own paperwork: contractors pulling a village building permit show workers' comp or disability and general liability, sidewalk dining or sidewalk sales need a liability certificate naming the village, and so does a special event. Vendors at the county fairgrounds on Prospect Street file a certificate naming the Agricultural Society. My office is in Clifton Park; I meet owners at their business, at the office or by phone or video.

What's different about insuring a business in Ballston Spa

  • Sidewalk dining and sidewalk sales. First-floor businesses in the village's Central Business District or Commercial District can use the sidewalk from April 1 to October 31 with a permit under Chapter 175. The village wants an indemnity agreement and a general liability certificate naming it, its officers, agents and employees as additional insureds, in force for the whole permit. The permit can't be transferred to a new owner. See restaurant and bar insurance, retail shop insurance and general liability; serving alcohol outside adds liquor liability.
  • Village events. A special event needs a certificate naming the Village of Ballston Spa as additional insured, any health department and State Liquor Authority permits attached, and an indemnity signature; outside vendors and entertainers file their own vendor permit application. See food trucks and mobile vendors.
  • The county fairgrounds. Anyone doing business on the Saratoga County Agricultural Society's grounds on Prospect Street, tenants and their vendors included, files an ACORD certificate naming the Society as certificate holder and additional insured on a primary, non-contributory basis, sent by the insurer or producer, plus a workers' comp certificate. High-hazard operations may need commercial auto and umbrella as well. See commercial auto and commercial umbrella.
  • Contractors and village permits. The Building Department asks every contractor for proof of workers' comp or disability benefits insurance and general liability, and the village can require new construction or major reconstruction to include sidewalk and curb work. Work at height carries Scaffold Law exposure. See contractor insurance, workers' compensation and certificate requests.
  • The county seat. The Saratoga County Clerk, at 40 McMaster Street, takes the assumed-name certificate a sole proprietor files to trade under a business name, and the amended certificate when partners, the name or the address change. Keep the policy's name and addresses in step with each one. New LLC? See business insurance for a new LLC.
  • Village or town. Part of the village lies in the Town of Milton, and Milton's own town offices have a Ballston Spa address. Which government issues your permits depends on where the property is, not the mailing address.

What Ballston Spa businesses carry

Required by New York

Workers' compensation from the first employee, part-time and seasonal staff included, and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Business vehicles need commercial auto; employees running errands in their own cars need hired and non-owned auto as well.

Required by your landlord, clients, the village and the fair

General liability naming the landlord or client as additional insured, the village certificates for sidewalk dining, sidewalk sales, events and building permits, and the Agricultural Society's certificate if you work the fairgrounds. For a shop, office or small restaurant, a business owners policy packages liability with property and lost income.

Worth adding

Liquor liability for any restaurant or bar that serves, because general liability excludes Dram Shop claims; flood insurance if FEMA's map puts your address in a flood zone, since commercial property excludes flood; cyber for card payments and client data; employment practices liability once you have staff; and an equipment floater for tools and stock that travel to events.

How I quote a Ballston Spa business

A short conversation about what you do, where, with how many people and vehicles, and what your lease, contracts, permits and event applications require; quotes from several carriers with what each leaves out, side by side; and once you choose and the policies are in force, I get you the certificates for your landlord, clients, the village or the fair. Afterward, one number for certificates, audits and claims. The business gap check takes three minutes. County filings and county road permits are on the Saratoga County business insurance page; nearby towns have their own: Malta, Saratoga Springs, Clifton Park and Wilton.

Questions

Common questions

Short answers to what people ask before they call.

Still have a question? Call (518) 902-8822 or book a call.

I want tables or a sidewalk sale outside my shop in Ballston Spa. What does the village need?

A sidewalk cafe, outdoor dining and sidewalk sales permit under Chapter 175 of the village code. It runs April 1 to October 31, renewable each year, and only for a business on the first floor in the Central Business District or Commercial District. If you rent, you need the property owner's written consent. Before the permit is issued you sign an agreement to indemnify the village and file a general liability certificate naming the Village of Ballston Spa, its officers, agents and employees as additional insureds, at the limits the law sets, for the whole permit and cancellable only on 20 days' notice to the village. The permit isn't transferable: a new owner, of the business or the building, needs a new one.

What insurance does the village want with a building permit?

The Building Department's requirements list proof of New York workers' compensation or disability benefits insurance, and general liability, from all contractors, with plans signed and sealed by a New York licensed professional. A homeowner doing the work files the BP-1 form instead, and no work starts before the permit. Under the village's sidewalk and curb policy, an application the Building Inspector deems new construction or major reconstruction also has to include sidewalk and curb installation, or a plan to fix deficient ones, unless an exception applies. Once the policies are in force, I get you the certificates.

I'm a vendor at the Saratoga County Fairgrounds. What certificate do they want?

The Saratoga County Agricultural Society's vendor handbook asks for an ACORD liability certificate naming the Society, at 162 Prospect Street, as certificate holder and additional insured on a primary, non-contributory basis, covering every day you're on the grounds, with a cancellation notice period and sent directly by the insurance company or producer, not by you. It also wants your workers' compensation certificate and your sales tax Certificate of Authority, and it may require commercial auto and umbrella for high-hazard operations. Send me the handbook pages and I'll match the policy to them.

My business has a Ballston Spa address. Is it in the village?

Not necessarily. A portion of the village lies in the Town of Milton, and the Town of Milton's own offices on Geyser Road have a Ballston Spa address. Which government issues your building, sign or sidewalk permit depends on where the property actually is, so check with the village or the town before you apply. Your policy needs the exact location either way.
