Business insurance in Malta
Malta has the county's largest employer on the Luther Forest Technology Campus, business corridors on Route 9 and Route 67, and restaurants and marinas on Saratoga Lake. Ballston Spa, the county seat, has a village business district with its own sidewalk rules. Here's what a business in either one usually needs and what the town and village ask for.
A business in Malta or Ballston Spa needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. Malta won't accept a building permit application without workers' comp, disability and general liability certificates naming the town, and Ballston Spa's sidewalk dining and sales permit needs a liability certificate naming the village. Contractors on the Luther Forest Technology Campus work to contract insurance terms, and the town records increased flooding along Saratoga Lake. I'm a New York property and casualty agent and broker in Clifton Park, quoting across the carriers I represent.
What's different about insuring a business in Malta and Ballston Spa
- Contractors and Malta building permits. The town won't accept a building permit application without insurance certificates: proof of workers' comp and New York disability coverage, and a general liability certificate with the Town of Malta as certificate holder. A soil disturbance permit asks for liability naming the town too. Add the Scaffold Law on any work at height. See contractor insurance, workers' compensation and certificate requests.
- The Luther Forest Technology Campus. Malta's 2023 plan names GlobalFoundries, on the campus, as the largest employer in Saratoga County and recommends allowing light manufacturing and warehousing for its nanotech vendors there; the state announced an expansion of the Malta plant in 2024. Contractors and suppliers working there sign contracts that set limits, additional insureds and waivers. See commercial umbrella, equipment floaters and professional liability for engineering and technical services.
- Route 9 and Route 67. The town zoned both corridors to draw business, and its plan steers commercial development to western Route 67 and Route 9 for the truck routes and the Round Lake Bypass, with gas stations, drive-throughs and auto repair named for the Exit 11 area. That means commercial auto, trucking, auto repair shops and gas stations.
- Downtown Malta. The town's Form Based Code covers Route 9 from Cramer Road to the Stonebreak Road roundabout. A new business moving into an existing space files a change of tenancy form with the town, and businesses are asked for a fire emergency contact form. The lease sets your liability limits and additional insureds; your improvements need their own cover. See retail shop insurance and business owners policy.
- Saratoga Lake. The plan describes longstanding restaurants and marinas around the lake and says the town has documented increased flooding along the waterfront. Flood is a separate policy; restaurants that serve need liquor liability. See restaurant and bar insurance and commercial property.
- Ballston Spa's village business district. Sidewalk tables and sidewalk sales need a village permit, April to October, for first-floor businesses in the Central Business District or Commercial District, with a signed indemnity agreement and a general liability certificate naming the village as additional insured. Village special events need a certificate naming the village too, and outside vendors file a vendor permit application. See general liability and food trucks.
What Malta and Ballston Spa businesses carry
Required by New York
Workers' compensation from the first employee, and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Business vehicles need commercial auto; employees running errands in their own cars need hired and non-owned auto as well.
Required by your landlord, clients, the town and the village
General liability naming the landlord or client as additional insured, the certificates the Town of Malta wants with a building permit, and the village certificate for sidewalk dining, sidewalk sales or an event in Ballston Spa. For a shop, office or small restaurant, a business owners policy packages liability with property and lost income.
Worth adding
Liquor liability for any restaurant or bar that serves, because general liability excludes Dram Shop claims; cyber for card payments and client data; employment practices liability once you have staff; and a commercial umbrella when a contract asks for higher limits.

How I quote a Malta or Ballston Spa business
A short conversation about what you do, where, with how many people and vehicles, and what your lease, contracts and permits require; quotes from several carriers with what each leaves out, side by side; certificates to your landlord, clients, the Town of Malta or the Village of Ballston Spa usually the same day once you choose; and one number afterward for certificates, audits and claims. The business gap check takes three minutes.
The Village of Ballston Spa has its own business insurance page.

Short answers to what people ask before they call.
Still have a question? Call (518) 902-8822 or book a call.
What insurance does the Town of Malta want with a building permit application?
Certificates come with every application, and the town won't accept one without them. A contractor doing the work provides proof of workers' compensation on form C-105.2, U-26.3, SI-12 or a CE-200 exemption, proof of New York disability coverage (DB-120), and a general liability certificate with the Town of Malta as certificate holder. An owner doing the work signs the BP-1 instead. A soil disturbance permit asks for liability with the town as certificate holder as well. Once the policies are in force, I get you the certificates, usually the same day.
I want tables or a sidewalk sale outside my shop in Ballston Spa. What insurance do I need?
A village sidewalk cafe, outdoor dining and sidewalk sales permit, which runs April 1 to October 31 and is only for a business on the first floor in the Central Business District or Commercial District. Before it's issued you sign an agreement to indemnify the village and file a general liability certificate naming the Village of Ballston Spa, its officers, agents and employees as additional insureds, at the limits the village law sets, in force for the whole permit and cancellable only on 20 days' notice to the village. Serving alcohol outside also needs your State Liquor Authority license in order, so match liquor liability to it.
I'm a contractor or supplier working on the tech campus. What will the contract ask for?
Read the insurance section before you sign, and send it to me before I quote. Contracts on large industrial sites commonly set the general liability and umbrella limits, name the owner and general contractor as additional insureds, ask for a waiver of subrogation and primary and non-contributory wording, and require workers' comp and disability certificates. Any one of those missing from your policy can hold up payment or the job. Tools and equipment that move between sites need an equipment floater.
My restaurant or marina is on Saratoga Lake. Is flooding covered?
Not by a standard commercial property policy; flood is excluded. Malta's 2023 comprehensive plan says the town has documented increased flooding along the Saratoga Lake waterfront, so look up the address on FEMA's flood map and price a separate flood policy for the building or your improvements and the contents. Boats and other property you hold for customers aren't covered by general liability either; that needs its own cover.
Are you in Malta?
My office is in Clifton Park. I meet Malta and Ballston Spa owners at their business, at the office or by phone or video, and handle certificates, audits and claims myself afterward.
