Business insurance in Saratoga Springs

Saratoga's businesses are busiest when the city is: track season fills the restaurants, the shops and the extra shifts. That's also when an uninsured gap is most likely to turn into a claim. Here's what a Saratoga business usually needs and what the season changes.

In short

A Saratoga Springs business runs on a season. Broadway's restaurants and bars need liquor liability under New York's Dram Shop Act on top of general liability; shops, salons and hospitality businesses add staff for the summer, and workers' compensation covers each of them from the first day, with DBL and Paid Family Leave once someone has worked 30 days in a calendar year; and the older buildings downtown need property terms that pay to rebuild them properly. Contractors working the city's historic houses add the Scaffold Law and their general contractors' certificate requirements. I'm a New York property and casualty agent and broker in Clifton Park, off Northway Exit 9, quoting Saratoga businesses across the carriers I represent.

What's different about insuring a business in Saratoga Springs

  • The season. The race meet at Saratoga Race Course, which a Saratoga County Industrial Development Agency study says runs from mid-July through early September, plus the summer around it. More customers, more staff, more deliveries and longer hours: payroll, liquor sales and stock all peak at once, and the policy should be written for the peak, not the winter.
  • Restaurants and bars on Broadway. General liability plus liquor liability, spoilage and equipment breakdown for the coolers, and hired and non-owned auto if anyone delivers. See restaurant and bar insurance.
  • Shops, salons and spas. Leased space downtown and in the plazas: the lease sets the liability limits and additional insureds. Salons also have the Department of State's requirements to meet.
  • Historic buildings. Older commercial buildings cost more to rebuild than their value suggests; replacement cost and ordinance-or-law coverage are what make a rebuild possible.
  • Contractors on old houses. The East Side and North Broadway Victorians keep a lot of trades busy, with the Scaffold Law exposure that comes with roofs and scaffolds. See contractor insurance.
  • City licenses for restaurants, bars, inns and sidewalk cafes. Under Chapter 136 of the City Code, eating and drinking, cabaret, lodging and sidewalk cafe licenses are renewed every year, and the application asks for a general liability certificate naming the City of Saratoga Springs as additional insured on a primary and non-contributory basis, plus proof of workers' comp and disability or a waiver. A sidewalk cafe that serves alcohol adds a liquor liability certificate, and the cafe operator pays for any damage to the sidewalk. See restaurant insurance and liquor liability.
  • Vendors and food trucks. A Chapter 165 peddling and vending license needs written approval from the Office of Planning and Economic Development and the land use boards first; the city's zoning guide lists the districts where vending may be allowed. The application wants a certificate naming the City as additional insured, commercial auto with each vehicle listed on the certificate, comp and disability or a waiver, and a state Health Department permit for food. See food truck insurance and commercial auto.
  • Festivals, races and events. Any festival, parade, race, fundraiser or other public event on public property needs a Chapter 199A special event permit, and the city won't issue it until the certificates are in: general liability naming the City as additional insured, commercial auto if vehicles are part of the event, and comp and disability or a waiver. Each vendor serving food needs its own state Health Department permit, and a private security firm has to be licensed, bonded and insured. See general liability.
  • Short-term rentals. Renting a unit for less than 30 consecutive days takes a Chapter 136A license for each unit, renewed every year. The city's checklist asks for a declarations page or certificate showing coverage for the building and liability for the property, and a property contact within 50 miles who can be reached around the clock while it's rented. A standard homeowners policy may limit or exclude rental use, so I check the wording before you list. See landlord and short-term rental insurance.

What Saratoga businesses carry

Required by New York

Workers' compensation from the first employee, seasonal staff included, and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Business vehicles need commercial auto.

Required by your landlord and lender

General liability naming them as additional insured, liquor liability if you serve or sell alcohol, and property cover for the building or your improvements. A business owners policy packages most of it for a shop or small restaurant.

Worth adding

Employment practices liability for a business that hires and lets go of seasonal staff every year, cyber for card payments and online bookings, and a commercial umbrella above liquor liability and general liability.

Questions

Common questions

Short answers to what people ask before they call.

Still have a question? Call (518) 902-8822 or book a call.

We add staff for track season. What changes on our insurance?

Workers' compensation covers every new hire from the first day; seasonal and part-time employees count. DBL and Paid Family Leave apply once someone has worked for you 30 days in a calendar year, which a summer hire often reaches. Workers' comp is priced on payroll and audited afterward, so tell me your expected seasonal payroll up front; a low estimate only moves the bill to the audit.

Do I need liquor liability for a bar or restaurant on Broadway?

Yes. New York's Dram Shop Act lets someone injured by a person you served unlawfully, visibly intoxicated or under 21, sue the business, and general liability excludes those claims. Liquor liability is a separate policy, and landlords and lenders usually require it. The limit should match your general liability.

What insurance does the city want with an eating and drinking or sidewalk cafe license?

The City's Chapter 136 application asks for a general liability certificate naming the City of Saratoga Springs as additional insured on a primary and non-contributory basis, with the City as certificate holder at the limits printed on the form, plus proof of workers' compensation and disability coverage or a waiver. A sidewalk cafe needs a valid eating and drinking license first; if it serves alcohol, a liquor liability certificate goes in too, and that policy has to provide for notice to the Commissioner of Accounts if it's cancelled or materially changed. You also agree to pay for any damage the cafe does to the sidewalk. The licenses renew every year, so send me the renewal date. Once the policies are in force, I get you the certificates for the City.

My shop is in an old building downtown. Anything special?

Check three things: that the property is insured at replacement cost, not actual cash value; that the improvements you paid for in a rented space are covered; and whether ordinance-or-law coverage would pay for the code upgrades a partial rebuild of an older building triggers. Business income cover keeps paying rent and payroll while the space is repaired.

Does my salon need anything the state requires?

New York's Department of State licenses appearance-enhancement businesses and sets insurance and bond requirements for them. I build the policy to meet those, then add what the work itself needs: professional liability for services on clients, and workers' comp for employees. The salon page goes through it.
