Business insurance in Galway

Galway is a town in western Saratoga County, with a village of the same name inside it, and describes itself as a rural community of small businesses, farms and homes, with year-round and seasonal residents. Its permit forms ask for proof of insurance with the town named on it, and its zoning sends businesses, and many home businesses, to the Planning Board. Here's what a Galway business carries and what the town asks for.

In short

A business in the Town or Village of Galway needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. Locally, the town's building, sign and peddler permit applications ask anyone other than the property owner for New York liability and workers' compensation proof naming the Town of Galway as additional insured, plus a hold harmless promise, and the town requires a special use permit with site plan review for businesses operating in the town. My office is in Clifton Park; I meet owners at their business or at home, or by phone or video.

What's different about insuring a business in Galway

  • A special use permit for businesses. The Planning Board's guide says site plan review is required to obtain a special use permit for all businesses operating in the town, and again for major changes in product lines or services. The review includes a public hearing. Make sure the policy describes the business the permit allows, since an unlisted operation can be a gap in cover. See business owners policy and general liability.
  • Home businesses. Anyone running a business, trade or profession from home applies to the Code Enforcement Officer first. Low-impact work with no customers, employees, signs or outside storage is allowed once confirmed; a minor home occupation with one employee or a major one with up to three goes to the Planning Board. A homeowners policy may limit or exclude business property and liability, and the first employee means workers' compensation.
  • The town on your certificate. The town's building permit applications ask every applicant other than the owner for New York disability, workers' comp and liability insurance naming the Town of Galway as additionally insured, plus a hold harmless promise. New York bars a permit for hazardous work without proof of workers' comp, and the Scaffold Law applies to work at height. See contractor insurance, handymen and DBL and Paid Family Leave.
  • Food trucks and peddlers. A mobile food unit needs a town peddlers permit, with liability and workers' comp naming the town, a county health permit, a sales tax certificate and the landowner's written consent, and it can't set up near schools in session, firehouses, public buildings or restaurants. See food truck insurance and commercial auto.
  • Signs go to the Planning Board. A permanent sign needs Planning Board approval before the permit, the same insurance naming the town from anyone but the owner, and an electrical inspection if it's lit. A sign contractor's certificate has to be in place before the work starts. See retail shops.
  • Farms and seasonal trade. The town describes itself as a rural community of small businesses and farming, with year-round and seasonal residents, and its permit forms include an agricultural occupancy class. Farm employees need DBL and Paid Family Leave like any other workers, and barns, equipment and farm stands each need their own line of cover. See commercial property and an equipment floater.

What Galway businesses carry

Required by New York

Workers' compensation from the first employee, and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Business vehicles need commercial auto; employees running errands in their own cars need hired and non-owned auto as well.

Required by your landlord, clients and the town

General liability naming the landlord or client as additional insured, and the liability and workers' comp certificates naming the Town of Galway that its building, sign and peddler permits ask for. For a shop, office or small restaurant, a business owners policy packages liability with property and lost income.

Worth adding

Liquor liability for any restaurant or bar that serves, because general liability excludes Dram Shop claims; an equipment floater for machines and tools that move between jobs; cyber for card payments and client data; a commercial umbrella when a contract asks for higher limits; and flood cover if FEMA's map puts your address in a flood zone, since commercial property policies exclude flood. See flood insurance.

How I quote a Galway business

A short conversation about what you do, where, with how many people, vehicles and machines, and what your lease, contracts and permits require; then quotes from several carriers with what each leaves out, side by side. Once the policies are in force, I get you the certificates for your landlord, your clients or the Town of Galway. Afterward, one number for certificates, audits and claims. The business gap check takes three minutes. What insurance does a Town of Galway building permit need?

The town's permit applications ask a property owner doing the work for a current CE-200 exemption form, and every other applicant, such as a contractor, for New York disability, workers' compensation and liability insurance naming the Town of Galway as additionally insured. The applicant also agrees to hold the town harmless for injury or damage caused by the work. Code Enforcement says most building projects need a permit, inspections need 24 hours' notice, and a Certificate of Occupancy or Compliance comes before use. Once the policies are in force, I get you the certificates.

Do I need a permit to run a business from my home in Galway?

The town's home occupation guide says you apply to the Zoning and Code Enforcement Officer before conducting any business, trade or profession from a residence. A low-impact home occupation, with no customers coming to the house, no employees outside the family living there, no signs and no outside storage, is allowed once the officer confirms it. A minor home occupation, with one employee besides the owner or tenant, or a major one, with up to three, needs site plan review by the Planning Board and a special use permit. On the insurance side, a homeowners policy may limit or exclude business property and business liability, and an employee means workers' compensation.

I want to sell food from a truck or trailer in Galway. What does the town ask for?

A peddlers permit. The town's application asks for New York liability and workers' compensation insurance naming the Town of Galway as additionally insured, a copy of your Saratoga County Department of Health permit and New York sales tax certificate, and the written consent of the landowner where you set up. You also agree to defend and hold the town harmless for claims from your use of public streets and property. The permit conditions keep mobile units from stopping near schools in session, firehouses, public buildings or restaurants, and bar overnight parking unless the permit says otherwise. The truck itself needs commercial auto.

Does a new sign for my Galway business need insurance?

Yes, if someone other than the property owner applies. The town's permanent sign application needs Planning Board approval before the permit is issued, the same disability, workers' compensation and liability proof naming the town as additionally insured from anyone but the owner, and a third-party electrical inspection if the sign is lit. Town Code §115-30 sets the sign rules by district.
