Business insurance in Burnt Hills and Ballston Lake

Burnt Hills and Ballston Lake sit in the Town of Ballston, which calls itself a Farms First Community and keeps its Town Hall on Charlton Road. Here's what a business in the town needs, and what the Building Department, the Planning Board and the Town Clerk ask for.

In short

A business in Burnt Hills, Ballston Lake or the rest of the Town of Ballston needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. The town adds its own paperwork: a commercial building permit application goes in with the contractor's certificate of insurance and workers' compensation, a new tenant in an existing commercial space files a change of tenancy form and may need site plan review, and renting the Jenkins Park pavilion takes a certificate naming the town. My office is in Clifton Park; I meet owners at their business, at the office or by phone or video.

What's different about insuring a business in Burnt Hills and Ballston Lake

  • Commercial permits come with certificates. The Town of Ballston's commercial construction permit application goes in with the contractor's certificate of insurance and workers' compensation insurance, as original signed documents, and work at height carries Scaffold Law exposure. Dock and boathouse work has its own permit application. See contractor insurance, workers' compensation and certificate requests.
  • The town inspects commercial buildings for fire safety. The Building Department carries out fire safety inspections of commercial and multi-family buildings, and its permit application asks for the fire district, the fire hazard level and whether the building has sprinklers. The same details shape a property quote. See commercial property.
  • A new tenant can mean site plan review. Moving into an existing commercial space starts with the change of tenancy form, and unless every condition in the town code is met, the change goes to site plan review; a change of use that alters parking, access, drainage, utilities or signage needs Planning Board approval. Signs need their own permit. Line up the lease, the permits and the policy start date together. See business owners policy and retail shop insurance.
  • Park pavilion rentals. Renting the Jenkins Park pavilion in Burnt Hills takes a liability certificate in the renter's name naming the Town of Ballston as additional insured, filed with the Town Clerk at least two weeks before the event. See general liability and, if you cater or sell food, food trucks and mobile vendors.
  • Farms and farm stands. The town describes itself as a Farms First Community with numerous farms and farm stands. Selling to the public from a stand brings customers onto your property, which is a general liability question as much as a farm one, and part-time help counts toward DBL and Paid Family Leave once someone has worked 30 days in a calendar year.
  • Which town, which county. A Ballston Lake or Ballston Spa mailing address does not mean the Town of Ballston, by the town's own account, and part of the Ballston Lake and Burnt Hills ZIP areas lies in Schenectady County. Permits come from the town the property is in. In Saratoga County, a sole proprietor's assumed-name certificate goes to the County Clerk at 40 McMaster Street in Ballston Spa, with an amended certificate when the name, partners or address change; keep the policy's name and addresses in step. What Burnt Hills and Ballston Lake businesses carry

Required by New York

Workers' compensation from the first employee, part-time staff included, and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Business vehicles need commercial auto; employees running errands in their own cars need hired and non-owned auto as well.

Required by your landlord, clients and the town

General liability naming the landlord or client as additional insured, the contractor certificates that go in with a town building permit, and the town's certificate for a pavilion rental. For a shop, office or small restaurant, a business owners policy packages liability with property and lost income.

Worth adding

Liquor liability for any restaurant or bar that serves, because general liability excludes Dram Shop claims; flood insurance if FEMA's map puts your address in a flood zone, since commercial property excludes flood; cyber for card payments and client data; employment practices liability once you have staff; commercial umbrella above the liability and auto limits; and an equipment floater for tools and equipment that travel to jobs.

How I quote a Burnt Hills or Ballston Lake business

A short conversation about what you do, where, with how many people and vehicles, and what your lease, contracts and town permits require; quotes from several carriers with what each leaves out, side by side; and once the policies are in force, I get you the certificates for your landlord, clients or the town. Afterward, one number for certificates, audits and claims. The business gap check takes three minutes. County filings are on the Saratoga County business insurance page; nearby towns have their own: Ballston Spa, Clifton Park, Malta and, in Schenectady County, Glenville and Scotia.

I'm a contractor pulling a commercial building permit in the Town of Ballston. What insurance does the town want?

The town's commercial construction permit application lists what goes in with it: two sets of plans, a stamped septic design where one is needed, an engineer certification where a design professional's stamp is required, and the contractor's certificate of insurance and workers' compensation insurance. The town wants original signed documents. New York's Workers' Compensation Law also bars a permit for hazardous work without proof of comp coverage. A homeowner doing the work files the town's BP-1 exemption form instead. Once the policies are in force, I get you the certificates.

I'm opening in an existing commercial space. Do I need anything from the town?

File the Building Department's change of tenancy or occupancy form. Under the town code, a change of tenancy in anything other than a one- or two-family home or mobile home goes to site plan review unless every listed condition is met, for example the new tenant is the same or a lesser intensity of use, needs no exterior changes and the site already has final site plan approval. A change of use that alters access, parking, drainage, utilities or signage needs Planning Board approval. Your lease will set the liability limits and additional insureds; I quote to those, and to the date you actually open.

We want to rent the Jenkins Park pavilion for a company event. What does the town need?

A certificate of liability insurance naming the Town of Ballston as additional insured, in the renter's name, covering the premises at Jenkins Park on Jenkins Road in Burnt Hills, delivered to the Town Clerk at least two weeks before the event, at the limit the rental page sets. The town says you can't rent the pavilion without it. If a caterer or vendor works the event, ask for their certificates too.

My business has a Ballston Lake address. Is it in the Town of Ballston?

Not necessarily. The town says a Ballston Spa or Ballston Lake mailing address doesn't mean you're in the Town of Ballston; you may be in Charlton, Clifton Park, Milton or Malta, and the Census Bureau puts part of the Ballston Lake and Burnt Hills ZIP areas in Schenectady County. Which town issues your building, sign or tenancy permits depends on where the property is. Your policy needs the exact location either way.
