Business insurance in Schuylerville and the Town of Saratoga

Schuylerville sits on the Hudson in the Town of Saratoga, a rural town of farms and small businesses that also holds the Village of Victory, the Saratoga Battle Monument and the Schuyler House. Downtown has galleries, shops and restaurants; the countryside has dairy, horse and fruit farms, some open to visitors. Here's what a business here carries and what the village and town ask for.

In short

A business in Schuylerville or the Town of Saratoga needs workers' compensation from the first employee, DBL and Paid Family Leave once someone has worked 30 days in a calendar year, general liability for its landlord and clients, and commercial auto for work vehicles. The village code adds rules: the owner or occupant clears snow and ice from the sidewalk, street and door-to-door selling needs a Village Clerk license, and digging into a street needs a permit and a bond. The town wants a contractor's certificate of insurance before a building permit. My office is in Clifton Park; I meet owners at their business, at the office or by phone or video.

What's different about insuring a business in Schuylerville

  • The sidewalk out front. The village code puts sidewalk repairs and snow and ice clearing on the owner or occupant, on deadlines after each snowfall, and the village can do the work and bill the property. No trade or signs on the sidewalk, cloth awnings only, and cellar trapdoors stay shut except for deliveries. A fall there is a premises claim, so the lease should say who clears it. See general liability and landscaping and snow plowing.
  • Downtown shops and restaurants. The village describes galleries, shops and restaurants downtown, and its NY Forward plans include a small project fund for facades and upper-floor apartments and a Canal Square renovation for more commercial space and flood resilience. Mixed buildings with apartments upstairs need a policy that fits both. See retail shop insurance, restaurants and commercial property.
  • Vendors and events. Selling on the street, in public places or door to door needs a license from the Village Clerk; farmers selling their own produce are exempt, and no license covers Sundays. Open alcohol on public land is allowed only at a gathering the village has approved. See food trucks and liquor liability.
  • Contractors and permits. The Town of Saratoga wants a contractor's certificate of insurance before it issues a building permit, and building in the flood plain area needs a special permit first. In the village, opening a street needs a Board of Trustees permit and a bond protecting the village; in Victory, the village asks you to contact its office or Code Enforcement Officer before any construction starts. The Scaffold Law applies to work at height. See contractor insurance.
  • Farms, horses and visitors. The town describes dairy, horse, fruit and vegetable farms, a growing horse-breeding business, and agri-tourism such as corn mazes, hayrides and pick-your-own. Paying visitors and other people's horses have to be named on the policy. Heavy equipment on the road belongs on inland marine and commercial auto.
  • The canal and the battlefield. The Old Champlain Canal runs through the village with a towpath and boat launch, and the town lists Saratoga National Historical Park, the Schuyler House and Lock 5 among its attractions. Guides, rentals and tours need the activity named on the policy. Flood is excluded from commercial property, so check FEMA's map for your address. See flood insurance.

What Schuylerville businesses carry

Required by New York

Workers' compensation from the first employee, seasonal staff included (farm labor has its own rules), and DBL and Paid Family Leave once someone has worked for you 30 days in a calendar year. Business vehicles need commercial auto; employees running errands in their own cars need hired and non-owned auto as well.

Required by your landlord, clients and the town

General liability naming the landlord or client as additional insured, with the sidewalk in front included, and the certificates the town or village asks for with a permit. For a shop, studio or small restaurant, a business owners policy packages liability with property and lost income.

Worth adding

Liquor liability for any restaurant, bar or event that serves, because general liability excludes Dram Shop claims; cyber for card payments and online bookings; employment practices liability once you have staff; an equipment floater for tools and machinery that move between jobs; and a commercial umbrella when a lease or contract asks for higher limits.

How I quote a Schuylerville business

A short conversation about what you do, where, with how many people and vehicles, and what your lease, contracts and permits require; quotes from several carriers with what each leaves out, side by side; and once you choose and the policies are in force, I get you the certificates for your landlord, your clients, the town or the village. Afterward, one number for certificates, audits and claims. The business gap check takes three minutes. County filings and county road permits are on the Saratoga County business insurance page; nearby, see Saratoga Springs, Wilton and, across the river, Greenwich.

Questions

Common questions

Short answers to what people ask before they call.

Still have a question? Call (518) 902-8822 or book a call.

Who has to clear the sidewalk in front of my shop in the village?

Under the village code, the owner or occupant clears snow and ice from the full width of the sidewalk and part of the gutter, on deadlines the code sets after each snowfall, and keeps the walk clear of other obstructions; sidewalk repairs are also the owner's or occupant's job. If it isn't done, the village can do it and charge the property. A fall on that sidewalk is a premises claim, so your general liability has to cover it, the lease should say whether you or the landlord does the clearing, and a plowing contractor you hire should name you as additional insured.

I want to sell food or goods on the street or at events in Schuylerville. What do I need?

The village code requires a license from the Village Clerk to sell on the street, in public places or door to door, with exemptions that include farmers and gardeners selling their own produce, and no license covers Sunday selling. Insurance is separate from the license: general liability with products cover, the organizer named as additional insured if they ask, commercial auto for the truck or trailer, and workers' comp for anyone who works with you. Open alcohol on village streets, sidewalks and parks is allowed only at a fair, picnic or gathering the village has approved, and serving there needs liquor liability.

What insurance does the Town of Saratoga want before a building permit?

The town's building permit instructions say the contractor must supply a certificate of insurance before the permit is issued, and construction in the flood plain area needs a special permit from the Building Inspector first. Once the policies are in force, I get you the certificates. Proof of workers' comp and disability coverage comes from the carrier on state forms, not on an ACORD certificate, and I ask the carriers to send them.

I run a farm that's open to the public. Is my farm policy enough?

Not always. The town describes agri-tourism as growing, with corn mazes, hayrides and pick-your-own. A policy written for a working farm may limit or exclude paying visitors, events and wagon rides, so each activity has to be named on the application. Boarding other people's horses needs cover for animals in your care, and farm workers have their own workers' comp rules, which I check against your payroll.
